CEO Bob Iger attributes that decline to fading post-Covid pent-up demand for travel to Florida, which DeSantis fully reopened from pandemic lockdowns earlier than other US states. ”If you look at the numbers in Florida in 2023 … versus 2022, where not as much was open and Florida was the only game in town, there is a lot more competition today,” Iger noted on the call.

You have no idea how many lawyers are hoping that Disney prevails with this argument because it totally exposes every Democrat governor out there for personal liability over their actions regarding Covid. Not to mention personal liability of every State Legislator for each and every gun ban that's been overturned as Unconstitutional.

And I absolutely will cum in my shorts if/when Fauci gets his comeuppance because of this.

OTOH, Constitutional immunity is Constitutional immunity and this argument is going nowhere. If Disney is lucky the court will look the other way regarding the frivolousness of it.

In the counterclaim, the company’s legal team, led by Dan Petrocelli, wrote that Disney is seeking unspecified damages and wants a court order that the board comply with a development contracts between the special district and Walt Disney World.
In February, the Disney-controlled board of the special district approved the development contracts, ensuring that the company’s Florida theme parks and resorts still maintained a degree of autonomy even after state law was changed later in the month. That bill allowed DeSantis to appoint his own members to the board of the district, which was renamed the Central Florida Tourism Oversight Board.
“As a direct and proximate result of the District’s anticipatory repudiations and, in the alternative, material failure to perform its duties under both contracts, Disney has suffered and will continue to suffer damages, including consequential damages,” Disney attorneys wrote.

The company seeks damages over the alleged breach, as well as a court order for the district to comply with development contracts that are at the heart of the legal fight between Disney and DeSantis.

Disney's requests came in a 55-page filing denying the district board's allegations in its state-level lawsuit against the entertainment giant. Disney's filing also put forward 12 "affirmative defenses" against the board, including that it lacks standing for its claims.

On the other hand, two of those regulations and controls are prohibitions against kickbacks and bribery. And it applies equally to both conservatives and liberals.
