The U.S. Constitution and the Democratic Party have a difficult time co-existing in America today, and it shows. Who can forget 2016, when Hillary Clinton campaigned to win the popular vote, forgetting that only the electoral vote really mattered in electing a president!

In a similar fashion, Speaker Nancy Pelosi knew that the House had the power to impeach a president, but seemingly forgot that only the U.S. Senate had the power to actually remove him from office! No sooner had the House vote its articles of impeachment against President Trump then Speaker Pelosi announced that she was prepared to withhold them from the Senate. Her idea being to force the Senate to follow procedings more to the Democrats’ liking. The scheme was based an op-ed piece by a Harvard law professor, Laurence Tribe, in the Washington Post.

Impeachment was passed last week without a single Republican vote. At her post-impeachment news conference, the Speaker astonished reporters by refusing to send the articles to the Senate. “So you may not send them?” a reported shouted. Pelosi's response: “You’re asking me, ‘So are we all going to go out and play in the snow?’” Bizarre.

If the Speaker seemed to be rattled in what ought to have been her moment of glory, it could be that she suddenly realized the predicament into which she had precipitated the House. If she holds out for a Senate trial that excludes those who have already made up their minds, it would exclude Democratic Party presidential candidates Elizabeth Warren, Bernie Sanders, Amy Klobuchar, Kamala Harris, and Cory Booker.

But that's not all. House Democrats want the impeachment prosecution to be able to call witnesses, particularly witnesses they failed to call during the proceedings in their own chamber, plunging ahead without them. Now they are also up against U.S. Constitutional proceedings in which “each House may determine the rules of its proceedings.”

That means that once the impeachment trial is underway, the House has to play by Senate rules instead of its own. Since impeachment started, Gallup reported that Trump’s approval numbers have notched up by six percentage point. It might even be helpful to Republicans to have Mrs. Pelosi hang onto the impeachment articles for a few more months, so that the President can generate even more popular support.

Democrats are still overcome with fury at the same U.S. Constitution that gives states' electoral votes the power to name a president over the winner of the popular vote. And that same Constitution puts the states in a position to acquit the President the people’s House impeached, and the Democrats hate that!
