I recall an episode of Law & Order: SVU in which a (very femme-looking) transwoman's lawyer talks her into accepting a plea bargain for a homicide -- and then she finds out it means she has to go to a men's prison because she hasn't had the surgery yet, therefore NY law still classifies her as a man. As might be expected, she is raped shortly after arrival.

I, too, remember this episode. This issue might never be solved to everyone's satisfaction. A trans woman is just as likely to be physically assaulted in a women's prison, as in a men's prison. So, what's the answer? We can't build prisons just for trans women, can we? You can not imprison trans women who commit crimes. I'm afraid at 78 years of age, I don't have any answer.
