I do not want judges guessing intent, flipping a coin in the back chambers when unsure.
That's a slope even bode miller would fear.
 
I have to disagree. Going to her house and checking out the neighborhood is just an extension of his fantasy. Now if he'd trespassed, or broken stalking laws, or otherwise harassed her, the situation would be different.
In some areas he did break stalking laws. In some areas, if he had a certain person in mind and he seemed to have malicious intent, he was stalking.

I once worked with a guy who got arrested for stalking. He never went to the lady's house. He always parked in front of the neighbor's house. But, he was also seen close to her in other places and while he never advanced to confronting her, it was still seen as stalking. When he was arrested, he had an illegal gun in the car. He did follow her from a distance, but he hadn't been closer than 100 feet of her. But what were his intentions with the gun? Should they have waited to see if he did something worse, or were they correct in arresting him when they did?

He was arrested and convicted. He's in jail, now. Well, it's been a while, so maybe he's been paroled. Maybe he's back in front of the neighbor's house again.
