Why Spiderman didn't make it into The Avengers

Well that largely has to do with Spiderman still having his rights owned by Sony. And they are not likely to ever give those rights up. So look for a spiderman movie at least once every 6 years from now on.

But there's also the fact that until Bendis decided to do 'New Avengers', Spiderman was never an avenger. (Not that this stopped him from being in the Avengers Porn Parody. Slinging a load of web onto Ms Marvel.)

And that was the classic team being used. (Just with Hawkeye + Black Widow in place of Giant Man + Wasp) Sides. Spidey makes an awful Avenger.
