It's lee 100* come Tuesday and the grass will need cutting. Go figure. I also need to spread some weed-be-gone. The new foundation next door will be a quagmire today.
Got the trip in to see the NP this morning. Packed my machine to take with me. Tooken. We'll see what she has to say. I'll ask her to order up some blood work, too, for the Tuesday trip so it'll be tooken care of early.

Not being familiar with the conditions you guys give them a lot of leeway in what they can do. Being on the council any public safety whether it's the participants or non-participants takes priority. Not only priority but is the only priority that you should be going by and it sounds like you are. What you can do in rebuttal is print the whole ordinance but not get into a pissing match with her and her daughter. Advisor that should future incidents persist additional steps may have to be taken as full enforcement measures may have to be enacted for the public safety. She could have been setting off the fireworks she was obviously blocking the road. 150 ft distance may not even be enough dependent upon what they were shooting off. Intoxication shouldn't be mixed with anything. You're not only protecting her and the ones that are shooting them off what about the neighbors roof that the fireworks May land on and start a fire? What about a kid that maybe two yards away and gets hit with one of them? By the police not acting you've assumed the liability of letting it continue. By not enforcing the laws which are on the books the police and Council may be held legally and civilly liable. Just be assured that you're doing the right thing legally just because you got some hot head that thinks she's going to change the world to the way she wants it. As long as you have the public interest and safety at heart nobody can challenge your decisions legally. Confer with the council or City attorney for further clarification or modification of the ordinance as it pertains to recent occurrences. I'm sure the attorney is going to say if it's not working it needs to be changed they don't want to put their neck on the line either. All I can say Miss k is ya done good. Oppps sorry suzie....Had quite the other council meeting last night. Everything was going fine until this group of three people showed up. They wanted to hijack the meeting and comment on everything. You could hear this woman and her daughter talking that's not right nope how is it their fault throughout the whole meeting. When we got to my portion which is records Rule and law and the ordinances were working on it was a s*** show. You want to have public involvement, but be respectful. Now she wants to come to our committee meeting. Which is fine, but she's going to get a big surprise because we don't have to humor her and committees. Our goal is to take care of the safety and well-being of all the citizens of our town, and we make decisions like that and that is the way it's going to be. The end that's it no more discussion. It all has to do over fireworks and people being upset because the police went and told him to shut it down and some tool bag this lady that showed up would be my guess put half of the rule online regarding time they have to end. But there's other portions of the rule/law. For instance Spectators 150 ft away. Well that's going to be hard to do since our Lawns are 60 ft wide and no alcohol and people were drunk and shooting off fireworks towards people's houses. They were setting them off in the middle of the street and closing off the road. They were setting them off in the middle of the State Highway that runs through town. They're damn lucky that we don't ban fireworks. Heavy is the head that wears the crown.

Here's a good one. Since the ordinance says 150' and the distance is only 60' between the residences. You may have to restrict what sections of towns are permitted for fireworks displays. But being all inclusive you may have to decide to not permit any fireworks so there's no discriminating between residents. And in the minutes thank her profusely by name for bringing it to the council and police departments attention. Yeah our pd was just started less than a year ago. We r trying to have an ordinance that protects everyone. Essentially we go by state law you can't go less than state law but you can make things more restrictive. So all of this stuff will be looked at by the lawyers. And we want to give guidelines for our PD to enforce. As it stands now state law allows for fireworks with some conditions, but at the end it says that this law orc is not affected by disorderly conduct law. So what that means is you can still get in trouble if you are annoying irritating causing distress to other people even if you're setting off fireworks legally. So we want to make it so people can set off fireworks but also take care of the needs of the people that don't do it don't like it or scared of it have PTSD animals that are scared Etc. Because if someone calls and says they're setting off fireworks and the ordinance says they're allowed to set off fireworks until 10:30 on 4th of July then we can tell the person that's calling they are allowed to set off fireworks until 10:30 please make arrangements for you and your family and for your safety. However if they are setting off fireworks at 10:45 the day after, which happens, then we go to the people that have set off fireworks and say the ordinance in the village says you can't set a fireworks at this time shut it down. If there's no ordinance at all and the police officer Drives By he can make his own decision on whether he wants to stop it or not, but if someone calls he has to follow the law and no police officer wants to arrest anybody, which happens if there's two calls, over fireworks. Council meetings are when people suckiness factor tends to peak… I would turn it around on her and tell her that if she’s that passionate around the topic, then she should run for town council. Be the change you want to see and all that.
I agree with oldermom, you should check with the attorney that represents your municipality to see what you are/not on the hook for.
Public safety is first and foremost. While it’s may be more of a nuisance, I hope no one will ever get hurt…
You may need to rewrite the law and have the police enforce it differently.
And you’re in an unenviable position, because people love their fireworks… the cops may or may not be enforcing the law…
Hahahaha her (a realtor) and her daughter who works in health insurance had opinions on zoning, firearms, golf carts (they said with a farm equipment placard it could be driven on streets-- no it can't because it actually has to be a piece of farm equipment with a start and stop destination in mind....like on a farm... driving to the post office from your house in the middle of town with a placard doesn't make it a piece of farm equipment). I have a form of Macular Degeration , but I have retina damage due to years of working in a darkroom setting, with intense light. I will see my Ophthalmologist next week to discuss options for possible treatment before getting laser eye surgery
