The issue is the Posse Comitatus Act of 1875. Did SCOTUS just invalidate it by saying that the President must use regular forces for civilian law enforcement first? Or did they strip him of his role as Commander In Chief?

The Insurrection Act is one way around the decision. So is a declaration of Martial Law. Both are valid options; the former to protect Federal personnel/property and the latter to quash terrorists and resistance to law and civil order.

The D's will immediately run to the courts to get a lib judge to place a stay on the declaration. Which, in proper response, would immediately result in an arrest of the lawyer, the parties in interest, and the judge who issues any ruling other than an immediate dismissal.

The problem is that any such act by Trump would be met with armed force by said resistance. Which would kick off a second civil war. Something to be avoided if at all possible.

I think if he declares the Insurrection Act that activates this key clause in the PCA, “except in cases and under circumstances expressly authorized by the Constitution or Act of Congress.” As you know, both of these presidential powers are statutory authorities used in conjunction with his Article II power.

PS: I think it means regular military forces as the invocation of those statutes presumes that regular police authority has failed. I think it elevates his CinC authority.
