Berkeley poised to honor PFC Bradley Manning as hero for the Democrat cause.

The United States is the owner of the information stolen. They can claim an international copyright on all of the information, with a fixed price value of $10 per work. Then under current law, they can inform ALL of the Internet's main trunk carriers that copyrighted works are being published, and within 24 hours of receipt of notice, the main trunk carriers will be held responsible for the fees. The main trunks control everything -- that's how they got rid of child obscenity on pretty much all of the Internet. The main trunk carriers can simply turn off any site that violates their global terms of service.

The U.S. should treat the Internet publications as a civil matter and seek monetary payments for copyright violations. Then treat the espionage and treason of Bradley Manning with a court marshal and 50 years hard labor once convicted.

The main trunks of the Internet are virtual (NPI) printing presses of money. They will immediately shut down any host using their bandwidth if they thought they would get tagged with a suit by the United States.

Also, you read it wrong. This has noting to do with the criminal law cases. I'm talking about shutting down all such publication of the materials. The criminal cases go on as usual.

I didn't call you dumb. I called the idea dumb. It helps a little that you are not proposing civil suits as a substitution for criminal prosecution. Kudos to you for that, at least.

But you still miss the mark. Government information is not supposed to be protected by copyright. If it's not classified (and as soon as it's legally UNclassified) it's supposed to be in the public domain. Scientific and medical research. Non-defense related technology. How do you think we got the internet and the world wide web in the first place?

The feds have two forms of information: that which is in the public domain (GPO stuff, etc.) and then it has not-for-the-public information that, while owned by The People (ends up in the National Archive perhaps) is subject to proprietary control of the feds. The idea was simply to find a way to exact sufficient punitive payment from the main trunk Internet companies (e.g. The Backbone Companies) to give them the heebie jeebies much the same as they might feel were their bandwidth clients posting kiddie porn. In under 72 hours, all trace of said information would be gone -- except for people who copied it into a file.... and no further information will be published. At ten dollars a word, per publication, it's not worth the risk.

The government often uses civil penalties for infractions of various sorts.

In any event, such a plan would only affect the publishers, not the thieves who stole the information in the first place. Thus, Manning would remain subject to the traditional firing squad, but the New York Times, WikiLeaks, and so on, are subject to civil penalties for disseminating stolen property in violation of the feds' proprietary right to control publication and dissemination of property it owns. While The People own the national parks, for example, that does not mean citizens are exempt from paying the gate fee to visit them.

Threats of monetary enforcement is much more believable than the threat that Eunuch Holder is going to file criminal charges against anybody.
