Attorneys for Kemp have argued that as governor, he has immunities that allow him to skip testimony. Fulton County Superior Court Judge Robert C.I. McBurney disagreed Monday and said he must testify.

He did, however, side with Kemp and said he can delay his appearance until after the general election on Nov. 8. Kemp is in a re-election race with Democrat Stacey Abrams.

"The governor must honor the subpoena -- as have the secretary of state and the attorney general and many other agents of the state in these criminal proceedings," McBurney wrote in the ruling. "Sovereign immunity wards off civil actions, not criminal ones."

According to the ruling, prosecutors cannot ask Graham about his “investigatory fact-finding on the telephone calls to Georgia election officials, including how such information related to his decision to certify the results of the 2020 presidential election.”

“The Court finds that this area of inquiry falls under the protection of the Speech or Debate Clause, which prohibits questions on legislative activity,” the order states.
The U.S. Constitution’s speech or debate clause states that members of Congress “shall not be questioned in any other place.”

“As to the other categories, the Court finds that they are not legislative, and the Speech or Debate Clause does not apply to them,” the order continues.
“As such, Senator Graham may be questioned about any alleged efforts to encourage Secretary Raffensperger or others to throw out ballots or otherwise alter Georgia’s election practices and procedures. Likewise, the grand jury may inquire into Senator Graham’s alleged communications and coordination with the Trump campaign and its post-election efforts in Georgia, as well as into Senator Graham’s public statements related to Georgia’s 2020 elections.”

I believe that the district attorney has already notified him that he is merely a witness in this. I don't think there is enough evidence to show that Senator Graham was aware of what some of the other people were doing as far as accessing voting machines, presenting false testimony to state legislative committees, so that means he'll have to appear and answer questions."

"Now, that the judge is requiring him to do so, he can't claim a Fifth Amendment privilege because he's not under the threat of prosecution in Georgia," he clarified. "As long as he appears and follows the judge's order, he should not face any legal exposure."

The disciplinary counsel’s office -- the enforcement arm of the Washington Bar -- has charged Giuliani with violating local attorney ethics rules by pressing a “frivolous” post-election challenge in Pennsylvania on behalf of former President Donald Trump. Giuliani has denied wrongdoing, arguing he acted in good faith in seeking to invalidate mail-in ballots at the time.

Giuliani assets will transfer to Georgia election workers he defamed

A federal judge has ordered former Trump lawyer Rudy Giuliani to place numerous assets, including cash, jewelry and his New York apartment, into a receivership controlled by two former Georgia election workers as they seek to collect a $148 million defamation claim against him.

The 24-page ruling issued Tuesday orders Giuliani to place the assets into a receivership within seven days. But U.S. District Court Judge Lewis J. Liman of New York ordered the “immediate turnover” of Giuliani’s apartment on the Upper East Side, which is already for sale.

Liman also orders Giuliani to take legal steps that would allow the election workers, Ruby Freeman and Shaye Moss, to seek an estimated $2 million in legal fees that Giuliani has said he is owed by Donald Trump’s campaign organization and the Republican National Committee for his work leading Trump’s post-2020 election legal challenges.
