Only in most countries. In several European nations, its legal. Just like beastility in Brazil; Not nessicerly smiled upon, but legal.
I've never actually done it or actually concidered it RL, but I find the idea intresting, and I know people who've done it. It happens, just like any other realationship.
Legal vs. Literary
Many of the stories that include or feature incest don't venture into illegal waters; although that doesn't matter anyway. Murder, or even theft, is very illegal, yet where would literature be if you couldn't write about those subjects? Just because it's illegal to do it doesn't mean it's illegal to write about it.
Anyway, "legal incest" could include step children (if they aren't legally adopted, or they are over the age of emancipation). That would make them acceptable for Literotica also, as they would be legal adults. I read a very interesting story years ago about a woman who encouraged her son to marry a girl she suspected of being bisexual, just so the mother could have an ongoing affair with her then daughter-in-law.

A movie by one of my favorite directors, John Sayles, has incest as part of the final denouement.
In that case, it is two adults incapable of producing a child deciding to give in to the tender, healthy passion of their love in contrast to the hatred and destruction and prejudice around them.
Having no siblings, it is hard for me to relate to anything like that, but I suppose that the consentual form is an interesting literary and intellectual exercise.
