Attorney General Ken Paxton Blocks Biden Administration from Disposing of Wall Materials Before President Trump Takes Office

Attorney General Ken Paxton secured a victory for President-elect Donald Trump’s border-security agenda during a hearing today before a federal judge. The hearing was called at Attorney General Paxton’s request to uncover potential legal violations committed by the Biden Administration after recent reports that segments of the border wall were auctioned off for pennies on the dollar.

The Biden Administration confirmed to the court today that it will agree to an order preventing the outgoing administration from disposing of any further border wall materials over the next 30 days—allowing President Trump to use those materials as he sees fit. This will be adopted as an order of the court, making it enforceable if any violations occur.

Additionally, the court stated that Texas is entitled to documentation proving that the Biden Administration has not violated an injunction secured by Attorney General Paxton in May of 2024 that required the Biden Administration to spend statutorily obligated funds on border wall construction after the federal government attempted to illegally redirect the money. If it is shown that the Biden Administration disposed of border wall materials purchased with funds subject to that injunction in violation of a court order—or that the Department of Justice made misrepresentations regarding the border materials that have been auctioned off—this would constitute unethical and sanctionable conduct, and the responsible parties could be held in contempt of court.

“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” said Attorney General Paxton. “This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda.”

They've been selling old border materials for years.

So we can't sell the excess materials from a wall that trump failed to build.

Stable jeenyus!

They've been selling old border materials for years.
They were doing it now to subvert the will of the people and the ability of the incoming President to enforce the law on the border. The Biden Administration is the enemy of American culture and national defense.

They are doing what they've been doing for years. The administration determined the material could be sold rather than having to lease storage locations.

They haven't changed their policy.

Once the incoming administration takes over, they can enforce their own policies as needed

Steve Bannon can make it all good from the money he stole from the mugs who contributed to the 'Build the Wall' fund.

If he's got any left that is, after he bribed Trump to give him his pardon.

I guess after next month we'll be obligated to again refer to Trump's vanity project as a "border wall" instead of a "border fence" again.

Please stop with the hyperbole and get your facts straight.

The plan for the unused material was decided in 2023, when Congress passed the annual National Defense Authorization Act and Republican lawmakers added a section directing federal officials to submit a plan to Congress on how to dispose of excess border wall material.

The Department of Defense submitted its plan in March, allowing the transfer of material to U.S. Customs and Border Protection and states, with a preference for southwest border projects. Congress required that any materials received by states be used to maintain current border barriers.

CBP, Texas and California received more than 60% of the material through a “reutilization, transfer, and donation process,” according to the Department of Homeland Security.

Patrick said in a Fox News interview Thursday that Texas also bought $12 million worth of material during a summer auction, enough to build about four miles of border wall.

How did wall materials end up being auctioned?

The remaining 40% was sold in June to government and military surplus company GovPlanet, which moved the materials to Arizona in December and listed them for auction on its website — some of it with starting bids of $5. GovPlanet had previously auctioned off other border wall material in late 2023.

The will of the people put Biden in the position to make the decision to sell it after four disastrous years of trump.

In another four years when short term memory americans realize what a disaster trump is once again, democrats can do it all over again.

Great job! What? Twenty-two days or so to go before Trump assumes office. That gives Biden time to relax and handle other chores. Who sells walls during the holidays–who buys them?

Hollow 'victory' for the Texas AG. The guy brought up on so many charges in his state that people there lost count of his shenanigans.

A border wall is a stupid idea. We would be far better off using the funds required to support and enhance the Border Patrol. Back when Trump was really pushing this, I did some research and figured out that for approximately the same cost as a wall, we could hire 8 more BP agents PER MILE with a job expectancy of twenty years. Some of the math was flawed because I didn't place a high enough cost on the training, equipping and hiring... however, there would also be a recovery of funds because those agents so hired would be paying taxes on their income. Also, they would be contributing economically to their new communities.

Johnson just promised funds to build the wall will be available. So there's that.

But it won't stop any coyotes.

Hiring more asylum agents (border kind, not looney bin kind that trump thought) would be a much better solution in conjunction with your proposal. His stupid ass is going to hire a bunch of new federal employees to deport 13-21 million taxpayers so if he actually had a plan, that would be a wash if not better for the US overall.

This is the pipe dream pushed by the Leftiods who will do/say ANYTHING against Trump's ideas and plans.

A border without a deterrent for illegal crossing is what we've had for the past 20 years. 40 million illegal aliens are here in the US because human personnel cannot be everywhere 24/7.

Meanwhile, a wall can be on station 100% of the time keeping illegals from crossing. At less cost overall.
