Legality of writing about minors in porn

Typically nothing from FO is valuable. Check some of his posts. He raised a big stink in Story Ideas bitching that Laurel wouldn't allow his kiddie rape stories here. He also likes to bump old threads about kid sex and pedophilia.

For what it's worth, in most of Europe the age of consent is either 14, 15 or 16. Personally, I'd be fine with reading stories with protagonists who were that age.

Aye, the USA - or I understand most of it - is almost the only jurisdiction in the world where the age of consent is as high as eighteen.

I lost my virginity at age seventeen to a sixteen yo lassie. Perfectly legal here. But I just can't say that in a story on Lit.
 
It doesn't make a lot of difference if they are sixteen or eighteen in a story. Writers can stretch the truth to suit their needs, and therefore meet the requirements of their publisher.

When you think about it, it's not the hard facts like age and measurements that make a story worth reading anyway.
 
No it's not illegal. Such situations pop up in published mainstream fiction from time to time.
 
Under the US Constitution, you can write about "anything" you want. Writing is protected under the first amendment as Freedom of Speech. In the United States, our Freedom of Speech and unequivocal and unparalleled compared to other countries. What you cannot do is posses or post pictures of children in any kind of sexual context.

However, while writing about underage sex is protected as freedom of speech, you may have to be able to afford the appeals process through the courts to prove it. Just because something is protected by the Constitution doesn’t mean that some Looney Tune prosecutor won’t try to put you in jail for it.

Some porn should be gone after. Personally for "realism's" sake I have no issues with slightly under age by a couple of years especially in a category like "First time"

However after seeing a story on ASTR featuring a 13 year old girl getting gang raped in graphic detail I pictured the type of person who could get off on this and started seeing these rules a little differently.

Philip Ray Greaves II was arrested in Pueblo Colorado in Dec. of 2010 after being charged in Polk County Florida with publishing a “how to” guide for pedophiles. Apparently he didn’t have the money for an appeals process.

If you start chipping away at our Constitution, where do you stop. No matter what Freedom guaranteed by our Constitution, you can find someone who will oppose it, and want the Freedom taken away.

I agree, some of the stories on ASTR are disturbing and disgusting; however, if people have a problem with pedophiles, (which they should), go after the pedophiles and leave our Freedom of Speech alone.

No offence meant, but I see on your profile picture that you have tattoos, which under our Freedom of Expression, (Freedom of Speech), you have a perfect right to have. However, you can find no shortage of religious zealots who believe the body should not be marked, and if given their way, would make tattoos illegal. Ask yourself, how much of your own personal Freedom would you like to give up just because someone disagrees with your choices in life?
