Just like if the gov in one State wants someone arrested and extradited in another State. If the foreign State refuses, there isn't anything the gov can do.

You BELIEVE they could. The reality may be something else. Neither sufficies in a court of law where THE LAW requires that the government apply with El Salvador courts for an order authorizing the extradition.

The US court cannot fault the government for applying as the law requires. Nor can they attribute any delay or denial to the US government.

He's a Salvadoran citizen, we have NO JURISDICTION over him regardless of our contract with El Salvador. To bring him back to the US we have to extradite him via the courts.

He had a removal order signed by a judge. That the removal order was stayed because he claimed (to a different judge) that he'd be persecuted doesn't change the FACT that he was here ILLEGALLY and had been ordered removed from the country.

Bringing his kid into the argument doesn't change that at all. Doing it shows how weak your argument actually is because you rely on emotion rather than FACTS to prove your point.

He then hired a lawyer to challenge that decision. Which resulted in more due process.

He was deported and hired another lawyer to challenge that. and the result is more due process.
