Under federal law (INA §287(a)(1)):
ICE agents may interrogate any person believed to be an alien as to their right to be or remain in the United States without a warrant. That means simply asking questions about immigration status does not require a warrant or probable cause. Consensual encounters are allowed (just like police asking questions). I already explained the law on deadly force and federal immunity to state law in another post. You might want to look up the following federal statutes as well:
18 U.S.C. § 111 — Assaulting, resisting, or impeding federal officers
8 U.S.C. § 1114 — Protected federal officers
18 U.S.C. § 1501 — Obstructing federal officers executing process
18 U.S.C. § 371 — Conspiracy to interfere with federal law enforcement
8 U.S.C. § 1324 — Harboring, shielding, or concealing illegal aliens
The ICE Gestapo has the "right" to ask you, but you have the "right" to remain silent.
