Secondly, understand that this is not lit's doing. It's thanks to our wonderful current incarnate of US government. If you hate these rules (which I do), VOTE DEMOCRAT next time. Or Independant. or Green. Or ANYTHING RUT REPUBLICAN. Republicans, for all their calling from the hilltops that they want to protect our rights, want to make sure we do exactly what their ideals and their interpretation of the bible dictates. For the extreme republicans that occupy office now, church and state are NOT seperate. This country has been going straight down the shitter for the past 5 years. And you can look at who's in charge for the reason why.

You can blame the good ol right wing uppity tight religious nuts for that one. They claimed they were trying to crack down on "child" pornography.. but really, they were just trying to push their morales onto every american.

That's when 2257 came into play (which I spoke out about quite a lot when it came about). Basically, any "adult" site had to either agree to conforming to the new law, which required any person or "producer" (in this case, Lit would be considered a "producer") posting "adult" material to have every "actor/performers" real name, any "stage" name, and their address on file for govt records ... or second option if they didn't want to do that was that they could only post "soft nudes" which basically would be like something you'd see in an art museum (that's where the list comes in of what is NOT acceptable to show on Lit)

Rather than trying to get every single person on Lit to hand over their info, Lit chose the second option. Hence why the more hardcore stuff is not allowed.

Now, I don't know if the govt has changed the penalty, but when it first went into effect, it was a fine of ... can't even remember.. a lot, like at least $1,000 to $5,000 per offence, with a chance of getting a limited time of 5 years in jail, per offence. So.. that is why Lit and the mods are VERY firm about not allowing those kinds of pix on here. And amazing how many people are completely clueless about the laws and rules, and continue to break them on here.

From the ruling: "Specifically, section 2257 requires producers of such material to ‘‘ascertain, by examination of an identification document containing such information, the performer’s name and date of birth,to “ascertain any name, other than the performer’s present and correct name, ever used by the performer including maiden name, alias, nickname, stage, or professional name,’’ and to record and maintain this information. 18 U.S.C. 2257(b). Violations of these record keeping requirements are criminal offenses punishable by imprisonment of not more than five years for a first offense and not more than 10 years for subsequent offenses. See id. 2257(i). Any matter containing such visual depictions must be labeled with a statement indicating where the records are located, and those records are subject to inspection by the government"

Beyond this, the Justice Department has changed the regulatory language and expressly suggested in its commentary that social networking sites may not be producers (either primary or secondary) at all under Section 2257, presumably because they neither select nor alter the images on their site (apart from policing against child pornography, obscenity, copyright, or other legal violations). This is a somewhat surprising – though again, probably necessary concession; and it remains to be seen how far it will go. Tube sites, for instance, may be similar to the social networking sites in the relevant respects. In any event, keep in mind a matter which the old Sundance case overlooked: in cases where users post images of themselves and intimates, the users may be primary producers even if the swingers’ magazine or the social net*working web site is not a secondary producer. Under such circumstances, the primary must place a disclosure statement on the image, and it is a crime for the magazine or web site (even if not a producer of any kind) to transfer the image if the image should, but does not, have the disclosure statement. The commentary makes clear that the Justice Department is now aware of this possibility. So here too, the developments are positive, but they are far from complete and far from definitive."



So... unless I'm reading that wrong, users that post things on here could still be held accountable for.

Other than that, the main thing I got from reading it is that they mainly changed the record keeping part of it. They didn't do away with it completely, just changing things a bit.. AND.. it's not a set in stone thing. It could change again (and again, and again).

I think Lit is just trying to be cautious at this point .. and until they are given a firm letter that things have completely changed and it's ok to go back to the old ways, I don't blame them.

I know there's no way in fucking hell that I would give all my info just to post a pic of my spread pussy on here (even if all the info was kept private and only seen by one person.. ie: the record keeper) No way. Not happening. Yeah, I did that for when I was with Southern Charms, but that was an actual BUSINESS.. and was needed for me to get paid. For a free site where it's just for fun? Nope. Forget that!

And call me crazy... but I don't think this is an area that the current administration really wants to mess around with. Not at this time, when there are so many other issues that need to be dealt with (hmm, like getting our economy back up).
