Judges are responsible for holding defendants or releasing them, regardless of bail.

A judge cannot hold someone without bail, except in certain circumstances. it would be a violation of the 8th Amendment. When the State mandates release without bail, the judge has no choice but to allow the defendant to be released on their own recognizance.
