If there is conflict over the common assets then yes, you are right. My own folks divorced some decade ago, and mom said "I don't want no money, have a nice life. See ya next weekend." (joint custody thing) There was even no paper work saying that she gave up those rights. Laywer said she had to file papers to claim the settlement. Which she never did.
