If the economy is doing well, unemployment is down, inflation is low, the stock market is nosing up and the country isn't involved in a war, who gives a fuck how many memos Obama writes?

The point isn't that EOs are going up. The real point is, they are not official EOs, they are memoranda which carry the same weight and legality as an EO. Obama writes these by the dozens and then claims "I'm issuing executive orders at the lowest rate in more than 100 years." Which plays on the ignorance of people who don't know about the memoranda, who run around talking about how Bush issued more EOs than Obama. It's a political gimmick to fool his ignorant base.

This kinda says stuff. The only one to have less memos than Obama was Bush II. It increases with every President. Why can't you see that as a trend that will continue on to the next President no matter they party?

Because that isn't carved in rock, nor the point. This is the point:

"Obama has issued 195 executive orders as of Tuesday. Published alongside them in the Federal Register are 198 presidential memoranda — all of which carry the same legal force as executive orders."

So Obama says, "I've written 195 EOs, less than any other President," but when you add his 198 memos, the total of Presidential directives comes to 393, making that statement a deception. Something Obama does more than any other President in history.

So it's only ok to take advantage (LEGALLY) of the system when Cons do it?

The are power. They have the force of law just like regulations. Unless overturned by a court which is hard to even show standing to initiate such a suit.

In this case they are not called Executive orders so he can claim to have done less than Bush. That is the only reason.

Bush did it because he got tired of the junior Senator from Illinois and Constitutional-lecture-note reader carping about how extra-Constitutional EOs are.

Some memos are just that, a way to get information out to departments. Those that direct action should be called Executive Orders.
