ICE to appeal judge's ruling requiring agents to follow laws during arrests


this is following some mistaken-identity/flight risk arrests made last summer.

One plaintiff in the lawsuit is Caroline Dias Goncalves, a college student from Utah who was born in Brazil but moved to the U.S. at age seven. She was stopped by former Mesa County Sheriff’s Deputy Alexander Zwinck in June 2025, ostensibly for following a semi-trailer too closely, and later detained by ICE.

Dias Goncalves had a visa issue but no criminal history. She was held by ICE for 15 days.

Another plaintiff is Refugio Ramirez Ovando, a lawful permanent resident of the U.S., who was on his way to work in Grand Junction in May 2025 when he was arrested by ICE, according to the lawsuit.

“An ICE agent later admitted that they had been looking for someone else and that Mr. Ramirez was arrested by mistake,” the lawsuit stated.

“Although they lacked legal status, each had deep and longstanding ties to their communities — including parents, spouses, children, stable employment histories, and active participation in their local churches,” the order states. “No reasonable officer could have reasonably concluded that these plaintiffs were likely to flee before a warrant could be obtained. Yet ICE nonetheless arrested each one immediately and detained them for significant periods, causing severe hardship and loss.”
The plaintiffs have also shown that not making individual determinations on whether people were considered flight risks was part of a broader ICE policy, practice or pattern, according to the order.

“Immigration officials are entrusted with enforcing the immigration laws and are authorized to pursue an aggressive deportation agenda. They may arrest and initiate removal proceedings against individuals they believe are present without lawful status,” the order states. “But in carrying out these responsibilities, they must follow the law.”

I'm sorry, but this messaging is just reckless and horribly worded. Don't "hunt down" agents when you take power. All this does is bring agitators to attack them now which will lead to more unnecessary deaths.
