SCOTUS ruled over the lower courts concerning whether POTUS could redirect DOD funds during a state of emergency. SCOTUS did rule indirectly in Trump’s favor by imposing a stay over the lower courts on constitutional authority of POTUS to divert DOD funds during a state of emergency but never ruled exclusively on the legality of diverted funds. Biden removed the SoE so the case could go back to the lower courts, Biden’s team is not so sure about relitigating that issue right now, probably to keep options open.

Here's the bottom line:

"In an unsigned order, justices said they ruled in favor of the administration partly because “the Government has made a sufficient showing at this stage that the plaintiffs have no cause of action to obtain review” of the administration’s compliance with the federal statute invoked to divert the military funds."

The diversion of funds was lawful under the "statute" invoked by the administration to do so.

I’m going on memory from 2 years ago and if I remember correctly the statute you’re referring to was the constitutionality of POTUS to redirect military spending in the event of a national security issue. The suit brought forward was to stop Trump from spending DOD allocated funds targeted for housing repairs, new housing for soldiers and base upgrades all of which didn’t impact readiness. I agree with you I just can’t find what I wrote back 2 years ago, it was a lot more detailed which included OMB statements and clarification.

It is used in your advertising, by lobby groups, it's a long list of groups and companies which poke, stoke and prod, and keep that fear alive.

I am not sure if it was McCarthy who really figured this out, or if it existed before, but he was the first one I saw using fear politically to get what he wanted.

No problem. My only point was to point out the left was close to 100% wrong legally on the statutory power of the President in matters of immigration, as most of their legal battles were lost in the SCOTUS or in the Circuit Courts.

100% agree....it is why it is easy to sell our peasant class on "build the wall" and "take our country back" and "MAGA". It is also why these folks are clutching their guns inside their houses waiting for word (as Dumpty did) to go and take what should be theirs.(as if someone is actually taking it from them).

The Former Guy tapped into a vein of resentment in upper midwest White supremacists in 2016. Thankfully, America came to its collective senses in 2020 and reverted to historic norms.

Republican state governments are working tirelessly to restrict access to the ballot box to preserve their shrinking power base and prevent a repeat of 2020.

If H.B. 1, the "We The People" act, becomes law than the Republican party will be nothing more than a shadow of itself going forward.
