Can I say that is discriminatory ? cause to me I think it is double standards when it comes to such things. And also a disrespect of sexualities.

Definitely discriminatory, but also a fact of life. It may only make you 10% more likely to be busted, but there IS a difference.

One factor in whether you get busted or get a warning is always the personal opinion of the officer on the act you were caught doing. I'm sure there are some who would be just as likely to bust anyone they catch and yes some who are bothered by gay sex and more likely to bust you instead of giving a warning. There may even be some cops, although rare I'm sure, who would be more likely to bust a straight couple that a gay couple. But double standard or no if you do something illegal (whether you think it should be or not) be prepared to get busted if caught and consider yourself lucky if you are just given a warning.
