It's extremely difficult to win the presidency without winning the popular vote. It's only been done once in the last 125 years or so, and I'm sure you know many people seriously doubt the legitimacy of that exceptionally rare example which occurred when Bush prevailed over Gore in 2000. I'd certainly take a bet that the winner of the popular vote this year will win the EC vote.

Clinton probably will win, but it's not a done deal. I think at present Trump has about a 40% chance of winning the EC vote, and about a 45% chance of winning the popular vote. But that's just a guess, and things are bound to change, one way or the other. Many a slip twixt cup and lip.
 
Gross negligence in handling classified materials is a crime. It is not necessary for the government to prove intent.

There is such a thing as turning a blind eye to crime when under pressures that seemingly you cannot understand.

It's like you guys completely forgot about Scooter Libby who was tried and convicted for far, far, far less than what Mrs. Clinton did, and here's the kicker, long after the whole world knew that it was Dick Armitage who leaked Plame's name to Novak. But you see he worked for a black guy and was politically untouchable because Powell is a specially protected political class.

Similarly, Cheryl Mills was the architect of the email scandal and that was Hillary's protection because the Democrats cannot be seen going after her, therefore all the big guns, especially the DC cocktail circuit were turned on Comey as they were Roberts before him.

But she is going to get the political equivalent of a trial and sentence in the next two months...

Comey had two choices politically because he was making a political, not a criminal decision. Between what the administration was signaling and the meeting on the tarmac, he knew there was going to be no prosecution of Hillary's criminal acts. The first, throw away his reputation by recommending charges against the wish of the government and the press and having them go full Ken Starr on him, ruining his life and turning the right thing into a criminal-like action that would be claimed to have been motivated by him being a Republican. The second, throw away his reputation by not recommending prosecution after detailing criminal activity, but in doing so, winning the forbearance of the Democrat Party and its propaganda wing allowing him to quietly finish out his time in office, collect his pension and quietly disappearing from the national stage.

What anybody else did it a moot point and a typical Sgt. Stutter tactic. The only thing that matters here is Hillary, Comey, the Administration, the press and the known facts.

She has also now claimed that she did not understand the marking system. She's been in government as a Senator and sat in on a committee that was dedicated no national security. She is clearly lying or completely incompetent.

Lastly, she couldn't remember much of anything, she says, because of her health.

A columnist for The New York Times, who you might think would cherish the First Amendment guarantee of free inquiry, actually called on Google to prevent internet searches about Hillary’s health to silence “conspiracy theorists.”

So we see the explanation, a frail old woman broke the law or was in a job in which she was no way qualified to be in because of a political decision to keep the potential Obama enemies close (and what has happened in the Middle East actually bolsters the incompetency aspect).
