There will a notice of appeal with a request to remain free on bond while the appeal is pending. If the appeals court refuses there will be a writ to the SCOTUS for a stay pending the outcome of the appeal.

If the appeal goes against Trump then SCOTUS will eventually hear the case, the stakes are too high for them to refuse cert.

When does it elevate from the state to the federal level? Wouldn’t this come before the NY State Supreme Court first?

Also providing to the world that the United States has been reduced to a banana republic whose national debt is climbing at 1 trillion dollars every 100 or so days ( which is unstainable).. by your own admission he has a million "man" army. A martyr, by definition, gives one's life for a cause. You are mistaken in thinking Trump is or would consider martyrdom for a cause.

He lives for one reason—to sustain himself at the cost of others. One need only recall his remarks about why soldiers gave their lives for others when they got nothing out of it themselves. A person with that mentality would never be a martyr.

Misconstrued statement. There were three categories the jury could associate with this: it violated a state election law; a federal law, or a state financial records fraud law. It didn't have to rise to the Federal one. It could be the other two.

The jury didn't have to specify which one they found valid. Irony there.

Additionally, if there is a legal question that requires immediate resolution or if there is a request for emergency relief, a party may petition the Supreme Court for review before the case has been decided by lower courts. The impending success of a national election comes to mind, This would take the shape of what is called an interlocutory appeal. I will note the court tries to refrain from taking these appeals but if the issue is important enough they might do so.

I'm glad this popped up as I was typing about the same thing. My gut says if sentencing is reasonable and delayed pending appeal, SCOTUS won't touch it with a 100 ft pole. If he's sentenced to 4 years in prison and walked out of court in handcuffs for immediate remand, I think we'll see some kind of emergency relief from somewhere.

I don't think there is anything in the case that SCOTUS wouldn't leave to the state courts to sort out first. No matter how many talking heads suggest it, IMO SCOTUS is not going to directly overturn his conviction prior to the standard appeals process playing out.

My prediction is we'll see Donald out on the campaign trail with little restriction, but he'll still be a convicted felon come November.

I agree with your gut feelings on this. I’m guessing you’re spot on, though I think justice could only be served if Trump was treated to at least the same penalty and period of incarceration as his previously indicted co-conspirator.


That whole issue of Cohen doing time but Bill Barr’s DOJ letting Trump off for the same crime shows the true political warfare in this case.

Trumps entire administration was the criminal cabal they try to accuse the Bidens of.

I do enjoy seeing Donald Trump brought to justice, but my enjoyment fell far short of orgasm.

The objective reality is that Donald Trump is a convicted criminal, and Obama, Biden, and the Clintons are not.
