As ordered by the court of appeals;

1. Garcia can be detained and NO federal judge can order otherwise. WHY? Because Article III courts have NO jurisdiction.

2. Garcia is under FINAL ORDERS OF DEPORTATION the orders are stayed for 30 days (beginning last Fri.) pending Garcia's appeal to the Immigration Board. If the appeal fails, he's out of here and NO federal judge can say otherwise. WHY? Because Article III courts have NO jurisdiction.

That can't be constitutional. Congress would not have the authority to place immigration proceedings entirely outside the jurisdiction of the independent judiciary, which these immigration courts are not.

Read the Constitution you moronic mouth breather. Congress has SOLE province over immigration law and the president has SOLE responsibility to enforce those laws. The article III branch has as much jurisdiction over immigration law as they do the federal budget.

Actually, the USA federal courts can declare laws in violation of the Constitution, and that includes laws regarding the federal budget.
