Kilmar Abrego Garcia has a Marijuana (M) leaf on one finger, a Smiley face (S) on the next finger, a thin cross (1) on the next finger, and a skull with the number three shape (3) incorporated into the design on the last finger. M-S-1-3.

It isn’t unreasonable to interpret the tattoos as an indication of gang affiliation, BUT THAT IS NOT THE ISSUE.

The deportation fuck up and the lack of due process IS THE ISSUE.

And if Abrego Garcia can be deported improperly and have it go unchallenged, then we are on the slippery slope towards fascism. (We ARE on the slippery slope towards fascism.)

I worked in a branch of law enforcement, and I would have been negligent if I had discounted those tattoos as POSSIBLE evidence of gang affiliation: specifically, MS-13.

But tats don’t mean much without corroboration and an individual’s proven connection to a crime or criminal organization.

The government has an obligation. Full stop.

That argument isn't just wrong, it’s a dangerous fantasy dressed up as legal theory. The Supreme Court doesn’t “reassert authority” by abandoning it. Declining to hear expedited cases or appeals from one administration, based purely on politics, isn’t judicial restraint, it’s judicial cowardice. Worse, it’s a willful dereliction of duty. The Court’s authority comes from upholding the Constitution impartially, not from selectively silencing one side like a petty gatekeeper.

Letting lower court rulings stand “regardless of constitutionality” is an open invitation to lawlessness and an abdication of the Court’s core role as a constitutional backstop. That’s not justice, it’s sabotage. If a judge ever endorsed this idea publicly, they wouldn’t be reasserting power, they’d be auditioning for a banana republic.
