When we learned about the Alien Enemies Act in high-school U.S. history, we learned of it as an Old Shame, enacted under a regrettably authoritarian, xenophobic and paranoid Federalist administration.

Democrats might want to rethink making Kilmar Abrego-Garcia the face of their movement if newly released body cam footage is any indication of where things are headed. And to be clear, that's rhetorical, because it's absolutely an indication of where things are headed.

For those unfamiliar with the Abrego-Garcia saga, the illegal immigrant was recently deported back to his home country of El Salvador. Because he was sent to CECOT, the Central American nation's gang prison (mostly made up of MS-13 members), controversy broke out about whether sufficient due process was given. Multiple judges have been involved, and the Trump administration has been ordered to "facilitate" Abrego-Garcia's return to the United States. There's just one problem: El Salvador said no, and since he's their citizen, the United States has no ability to undo his deportation. That's left the two sides of the issue in a stalemate.

But while that's the very abbreviated version of the situation, the more interesting part of this has been the Democrat response. Immediately, they turned Abrego-Garcia into a symbol of their anti-Trump resistance, with left-wing press outlets taking to calling him a "Maryland dad" to project sympathy. Is that all he is, though? Let's just say it's a bit more complicated.

While Abrego-Garcia has been alleged to be an MS-13 member from the beginning of this story due to some very compelling evidence, more recently, it was revealed that his wife also took out multiple restraining orders against him after he allegedly beat her. Then there was a traffic stop in 2022 where the now-deported illegal immigrant was suspected of human trafficking. That's where this newly released body cam footage comes into play.

WASHINGTON (TNND) — A federal judge has issued a significant ruling, barring the Trump administration from deporting Venezuelans from Texas under the Alien Enemies Act.

U.S. District Court Judge Fernando Rodriguez Jr. ruled that the 18th-century wartime law cannot be used against individuals the administration claims are gang members invading the United States. Rodriguez Jr., nominated by Trump in 2018, is the first judge to do so.

However, he stated, "the President’s invocation of the AEA through the Proclamation exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute’s terms."

In March, President Donald Trump issued a proclamation alleging that the Venezuelan gang Tren de Aragua was invading the U.S. He said he had special powers to deport migrants identified by his administration as gang members, without usual court proceedings.

The declassified assessment said that most of the intelligence community "judges that intelligence indicating that regime leaders are directing or enabling TDA migration to the United States is not credible."

A federal judge in Pennsylvania has sided with the Trump administration in its invocation of the Alien Enemies Act to swiftly deport illegal immigrants that are part of gangs that have been designated as terrorist organizations.

Judge Stephanie L Haines for the US District Court for the Western District of Pennsylvania wrote, "As the Court stressed at the beginning of this Opinion, this case implicates significant issues. In resolving those issues, this Court’s unflagging obligation is to apply the law as written. When the Court does so, it finds that the Proclamation now at issue complies with the [Alien Enemies Act], and the Court further finds that Respondents must provide greater notice to those subject to removal under the AEA than they are currently providing."

"Having done its job, the Court now leaves it to the Political Branches of the government, and ultimately to the people who elect those individuals, to decide whether the laws and those executing them continue to reflect their will," she concluded.

Haines wrote in relation to the proclamation issued by Trump in March invoking the Act, "the Proclamation and the Declarations that Respondents have submitted to this Court indicate that there is factual basis for President Trump’s conclusions in the Proclamation."
