The Law Can Get It SO Wrong SO often!

I often get asked here why I left Australia and how I can bear to leave such a beautiful country. Beautiful it is in terms of natural beauty, and some of it's people, but this story further demonstrates the politics and underside of Australian culture which made leaving easy, and in some part for me necessary, and saddens me no end to see it is still cultivated and promoted by our Anglo based government as acceptable.

Very weird, but the real sad part is, I'm not so sure it is much better in other parts of the world.

Just checking the law here for the case you linked:
First, 2 years minimum sentence, because she is 10 and because it was a group, consent doesn't matter. Sounds better at first.

But now we come to the exceptions:
1) As the attackers aren't adults, the punishment can be lowered down to 6 months jail.
2) If the sentence is less than a year, the judge can put them on probation instead.

I guess the problem is not the law, but the prosecutors. If they already ask for a minimum charge and/or don't appeal against such a judgement, then we already have a problem. So I guess the difference in the countries is more of what persons are put in charge, instead of how laws look like.

Update...good news is the new PM has called for a review and said he is outraged this judge has let all these rapists off..community leaders have also spoken out to say there are also no cultural grounds this female judge can use to excuse her statements and judgement . Bad news is the child in question was gang raped at 7 and sent away for awhile and when she returned was again gang raped, now aged 10...what sort of life is she ever going to have?
