There is no evidence that the gun misfired.

It's pure speculation meant to excuse the agents' unnecessary escalation and reaction.

None of them show the gun firing. The closeup (read: zoom) of the gun.is not clear enough to see any firing of the gun.
Get a clue. It doesn't fucking matter whether the gun discharged or not. The announcement of a gun during a physical altercation is all that's needed to provoke lethal response.

The Buddha's path of practice is called the Noble Eightfold path. The eight components of this path, as presented in traditional order, could be briefly described as follows:

1. Right View (Understanding). This is the right way of interpreting and viewing the world. It involves the realization of the three signata in all phenomena, and of the Four Noble Truths as being applicable to the human condition. 4. Right Action. This refers to willful acts done by a person, whether by body or mind. Under the former it involves such forms of ethical conduct as not killing (or harming) living beings, theft, sexual wrong-doing, etc. On the positive side right action, also called wholesome deeds, involves acts of loving-kindness (mettâ), compassion, sympathetic joy, generosity, etc.

5. Right Livelihood. This involves not choosing an occupation that brings suffering to others, e.g. trading in living beings (including humans), arms, drugs, poisons, etc.; slaughtering, fishing, soldiering, sooth-saying, trickery, usury, etc. This provides the economic blueprint for a truly Buddhist society.

6. Right Effort. This has been described as "the effort of avoiding or overcoming evil and unwholesome things, and of developing and maintaining wholesome things." Right effort enables an individual to cultivate the right frame of mind in order to accomplish the ethical requirements under right speech, right action and right livelihood. It is generally presented as a factor of mental training, enabling individuals to develop the sublime states of loving-kindness (mettâ) compassion, sympathetic joy, and equanimity. However it has a general applicability and the effort could be directed to all wholesome activities.

7. Right Mindfulness. This is the basic Buddhist technique of cultivating awareness. Although viewed as a meditation component in fact right awareness has a wider applicability.

Which was, again, reversed on appeal. Essentially the lower court order exceeded the court's authority AND merely ordered ICE to "obey the law" which is considered constitutionally vague and ambiguous.

I'm of the opinion that those kinds of orders are ones where the court is intentionally setting the stage for a contempt hearing since anything the gov does can be claimed to be a violation. Thus, the court isn't dispensing the law, its dispensing activism which is based on actual bias.

They do tend to rally those faithful to the cause and stir emotional outrage though.



No they don't. In one, an ICE agent was illegally trafficking kids. That's not in his job description any more than a cop can deal drugs as part of his job.

An officer involved shooting while in uniform and performing police business isn't the same thing. Even acknowledging that a cop can commit murder (like in the Floyd case) doesn't get you past the Federal preemption in this case because there are no facts to show that the officer acted in any illegal manner.

You can believe differently but you need actual facts, which a reasonable person would agree with, to say otherwise and those facts don't exist here. Pretti assaulted the agents, destroyed property, and resisted arrest while armed. As soon as the gun was discovered, a reasonable police officer would be afraid for his life/safety. When the gun discharged that was enough for the officers to shoot.

Want to hear what else would be a sufficient impetus for the officer to shoot in self defense even if the gun hadn't gone off? A firecracker thrown by someone in the mob.

Think about that the next time someone in the mob lights a fuse.



If the State arrests any ICE agents for the shooting, the first motion before the court will be to remove the case from State court to Federal Court. The State court judge will either; A) deny the motion, or; B) grant it based on the law and precedent. If the State court denies the motion, that will be appealed as a writ in Federal Court, which will grant the writ and transfer jurisdiction to Federal Court. Where it will be dismissed.

If the State court judge grants the motion for transfer of jurisdiction to Federal Court, it will be dismissed by the Federal Court after a 12(b)(6) motion - failure to state an actionable claim (based on immunity and self defense).

This is the law and it ends the same way no matter which route is taken. The only other possibility is that the appeals court refuses to reverse the State court judge's denial and it goes to trial. Upon verdict the outcome can be appealed immediately to the Federal Appeals court as a violation of statutory and Constitutional Rights. At which point the verdict can be vacated and the matter dismissed.

Those who want to see the agent tried and convicted anyway, even knowing he'll eventually have any guilty verdict annulled, should understand that if that happens they would have no immunity for their part in how it goes down. The agent can sue the DA, the cops who arrested him, the trial judge, and the Governor in their personal capacity as well as the State. Any individual found to have materially participated in the illegal persecution of the agent will then face a federal criminal indictment under Section 292.

The taxpayers aren't immune either, they will pay higher taxes as a result of the money paid to the agent.

All in all, this narrative only ends in 1 way. Prolonging it only makes it worse and causes more suffering. The solution is to just stop pushing the losing narrative.
