Judges are not omnipotent kings with the power to render judgement on an issue they run into in their day-to-day lives. The mercy of the Court would only apply to specific issues before the court in a specific case brought before that Court.

They are judges by the fact of their appointment but those in question have one foot in the judiciary and the other in the legislature.
