I would say any act that brings you to climax or is attempting to would be sex. So if two people were next to each other and masturbating but not touching then they each had sex with themselves but not each other. If one of them does something to help and influence the other then they had sex. Maybe just my opinion though.

I guess it depends on the individual, but to me unless there's actual penetration it's mostly foreplay.

I believe the case of Bill Clinton, the Supreme Court ruled that "having sex" is the act of intercourse. Clinton receiving a blowjob from Monica was not sex. So going with that, sex is only intercourse (penis and vagina).
No, what happened was he was held in contempt of court by a Federal judge (not at the Supreme Court) for giving misleading testimony by saying he didn't have "sexual relations" with her.
