He won't have to Smith will be fired before Trump takes office and the cases dropped as I said. The documents case was already thrown out, and the SCOTUS has tipped its hand about Smith being hired illegally. Trump has already said he would fire Smith on day one. The DOJ is simply cleaning house to avoid embarrassment after Trump is sworn in. Also the DOJ's own policy prevents the prosecution of a sitting President.That's not what was announced.
DoJ is winding down the cases due to his election.
No other reason.
