Lawyers familiar with how nuclear secrets are classified say otherwise. They’re classified by Congress, not the Executive Branch. The President doesn’t even have direct access to the original documents. He can only view them temporarily on a need-to-know basis.ALL authority to classify/declassify comes from the President. Congress has no say in that AT ALL.
When it comes to declassifying documents, the President does what he wants at his pleasure and desire. NO ONE has any ability to tell him otherwise or interfere with his decisions. No rule/law/statute/bill or anything changes that.
So, if Trump says he declassified the docs at Mar A Lago, then they were declassified. Period.

I don't smoke and I am not fucking nuts. Don't get your panties all up in a wad; it's bad for your health.WTF are you smoking? That he has the power to declassify something doesn't mean he declassified it even though he said he did?
Are you fucking nuts? Do you even read what you post?
Trump now says that it was a joke. Did you laugh? This is about as bad as it gets. Trump gets asked a gotcha question and answers it appropriately that he's going to be a dictator FOR A DAY on day one.
FOR A DAY.
I watched that on television also. He was given ample opportunity to reject that notion, yet he drank the idea in. I saw no signs of anyone laughing at his 'joking remark.' The newscaster didn't follow up on that statement to determine if he was joking. Perhaps it goes with the drinking bleach or an injection of bleach to fix the Coronavirus he made and later claimed was a joke as well.Trump now says that it was a joke. Did you laugh?
Did anyone laugh?
Good observations. His view is either/or is correct and lacks the ability to find compromise in such issues.HisArpy brings up an interesting but incorrect point about both if two lawyers come to different conclusions one of them is wrong. Unfortunately the way US law works both may be correct or both may be wrong or there is no right and wrong on a given issue for varying reasons.
You should definitely look at more than one legal opinion on anything if you have the time but if you pick a lawyer or group that routinely gets it right you aren't gonna be wrong 50% of the time. Not even close to that.
That being said I can't comprehend how anybody still thinks Trump didn't break the law. You can argue if you like that it was no big deal or that everybody does it. Which is probably at least partially true.
Now as then, it works precisely because the truth about Republicans sounds to the uninformed like it must be an exaggeration. I was going to add an "and they know it" there, but in the case of Reichguide, I don't think he does, I think he's so steeped in his own bullshit that he really believes it.
I don't smoke and I am not fucking nuts. Don't get your panties all up in a wad; it's bad for your health.
Perhaps I could have said that better. Let's see if this helps you to understand the point.
Trump didn't follow protocols for documenting declassification. Everyone in the world knows that. Protocols require/mandate documentation and communication with the originators of the said documents to inform them of such declassifications.
Trump has no written records of what he claims to have declassified. So no one knows, on record, if he actually declassified them by telepathy perhaps. Everyone on Earth knows he lies - a pathological lie status, so it isn't out of the realm of believability that he lied about this declassification of the classified documents he concealed at Mir-a-Lago. He has no proof of his actions, no communications, no verification processes. The onus of proof that he did declassify is on him. But to illustrate that point, consider the following.
In one of the recorded audio tapes concerning this matter, Truman can be heard brandishing a document and informing the person capturing the conversation that it was classified. He asserted his authority during his presidency, mentioning that he had the ability to declassify such documents. However, in a somewhat ironic twist, he smirked at the realization that, as an ex-president, he no longer possessed that declassification power. The lady with him chuckled and made a remark, highlighting the newfound challenge. Consequently, Truman found himself holding a document that he openly admitted, on tape, to have retained its classified status even after his presidency. He told the individual not to get too close; you aren't cleared to see this - or words to that effect.

HisArpy left out an important point: lawyers do not get to decide the cases. That decision is in the hands of a body of mutually agreed-upon jurors that those two lawyers have accepted as least biased decision makers. Lawyers make their cases as to the facts at hand, and the jurors determine the outcome. There are appeals for those and final determiners up-line in the judicial system. Those are the checks and balances we await in Donald Trump's plethora of legal cases.
Given the number of cases and alleged crimes before him, according to HisArpy, at least 50% of them should find him guilty. I'm okay with that. Hopefully, that guilt will be for the most egregious ones that preclude his serving as President. My opinion.
That's BS. Post the statute word for word.Lawyers familiar with how nuclear secrets are classified say otherwise. They’re classified by Congress, not the Executive Branch. The President doesn’t even have direct access to the original documents. He can only view them temporarily on a need-to-know basis.
Lawyers have opinions just like the rest of us
You don't get it. Nobody subordinate to the President creates "protocols" that bind or direct the President in classification authority or any other executive authority. Right now the primary directive is Executive Order 13526 issued by Barack Obama, and it can be cancelled and a new directive issued by any subsequent President.I don't smoke and I am not fucking nuts. Don't get your panties all up in a wad; it's bad for your health.

They want to redefine reality to justify their attacks on Donald Trump. Opinions and dicta aren't the law.dudly, the ONLY protocols which matter belong solely to the President. And he gets to classify/declassify AT WHIM. You thinking there are some rules which limit his ability is where you start snorting out wackiness again.

I'm waiting for BSG to post the statute that restrains or overrides the classification authority of the President. They believe they're smart. They're not but they believe they are...

Huh? Moscow has a 'regime that exalts nation and often race above the individual and that stands for a centralized autocratic government headed by a dictatorial leader, severe economic and social regimentation, and forcible suppression of opposition'.I noticed that ninnygirl started a thread in which she vilified Tucker Carlson for going to Moscow. Meanwhile somewhere around here she stated unequivocally that she agrees with most of the socialist agenda.
Two tongues, one mouth on that one.

You're universally recognized as the dumbest person here, Derpy. Smart people know this. They believe they're smart. They're not but they believe they are...
Thanks for the reference in this conversation on the Mir-a-Lago issues. You don't get it. The left hates the truth when it works against their messaging. Post the statute. Thanks for the reference in this conversation on the Mir-a-Lago issues.
Yes, Obama's EO 13526 is still in effect. Trump did not cancel it or issue a new directive during his term. Biden has not modified or canceled it either. It is much too long for Trump to have read any of it and certainly too complicated for him to determine that he needed to do so if he wanted to use his telepathy to declassify nuclear top-secret information. That preposterous joke should have bothered you from further defending his powers to declassify.
I read the entirety of the document. It addresses controls below the Presidency levels - those he oversees, but not all levels he does not oversee. It supports your view about 'not getting it' as far as it goes - if you only read this document. You must expand your readings.
The executive order does not address the regulatory restrictions that Congress placed on the Department of Energy not within the prevue of the presidency. The President does not control Congress' Top Secret Nuclear documents regulations. Consequently, EO 13526 does not pertain to what Trump thinks he declassified or allegedly declassified using his mystical powers of mental declassification.
Declassification is a serious subject matter – Donald's mental declassification notwithstanding. It is thoughtfully regulated with complex procedures and levels of authority entwined within it to protect the sensitivity of the documents, human resources, the subject matter details, and the possibility of foreign entities obtaining and using those secrets to our disadvantage.
I get it. I get that you have some incomplete information you are using on which you base your opinion.
Moreover, Donald Trump has no concept of National Security. He functions at his own ego level. That much of his behavior is well documented. Returning him to the Presidency places the USA at grave risk - that should concern every American - even Trump zealots.
