A friend pointed out to me that years ago (before Trump the politician) he was defended by some very competent lawyers from top firms. Said friend suggested that in civil actions, he likely had the benefit of legal expenses being insured, either through his companies 'Directors and Officers" Liability coverage, or their Third Party Liability covers. Insurers have massive legal budgets and they invariably employ only the very best legal advice. However, as the litigation started to pile up and particularly after the Trump University fraud, the quality of Trump'[s legal advice took a nose dive. It became evident that he no longer had insurance coverage and thus access to their top flight lawyers - and even worse the debts were now his own. Then it was reported that the lawyers he did instruct may have been stiffed on their fees. I doubt there is a reputable firm left that would take on Trump as a client, apart from the fees issue, reputational damage would inevitably be severe.

On an entirely different issue, whatever fiction one accepts as Trump's total wealth, most of it is tied up in notoriously illiquid real estate - and who will lend a dime on that security? If a substantial fine is levied as expected in the over valued accounts case, the possibility of a cash shortage could strike home severely. MAGA folks may lack the resources to come to the rescue. $83 million might be possible but $250M to $300M+?
 
What this verdict reveals is: We are here because Trump lacks self-control. He feels he can do anything to anyone at any time, especially women. He didn’t respect E Jean Carroll’s boundaries. He could not stop defaming her, even after losing his initial civil case. And a sitting judge scolded the former president that he could not control himself to which trump acknowledged by saying, ā€œYou can’t either.ā€
No self-control, but yet desires access to our nuclear launch codes. Unfit for office then. Unfit for office now.
 
I think the main lesson is: if you're on trial and your freedom or a lot of money is at stake, get a good lawyer and keep your mouth shut.

It was not admitted for a reason. It was not allowed because it did not relate to the current case. It might have been in the first one, but Trump's lawyers missed the deadlines for submission in that case. This was not some activist judge coming down on Trump's team. It was a procedural matter. Trump's neophyte lawyer repeatedly tried to introduce such non-admissible evidence about the first trial. The judge finally told her she was borderline being slapped with a fine and to sit herself down. [Goes to show she needs some more experience, one would expect.] The last case, 83.3m, was to determine payment for defamation, not whether Trump was guilty in the first case. That ship sailed in the last case. He lost. Trump was already guilty of a sexual crime before he got to this level. This case was just about his continued lying about the verdict and defamation of Carroll after being directed to desist from continuing his repetitive lying.

A number of former district attorneys noted today that the number is only a 3x ratio punitive damage matter. Apparently, this is a low amount by that standard and within the parameters that upper courts routinely run as a good call. According to those experts, upper courts sometimes reduce the amount once the punitive damages exceed a 6x ratio. Those same experts noted that nothing in the proceedings stood out as potential total dismissal for cause. Their experiences and assessments point to the 83.3m sailing through any appeal judge as a loss for Trump.

My best guess is Teflon Don isn't so slick anymore. His appearance at the rally tonight was evident that the sting of 83.3 million chapped his ass. He kept quiet for a change.

Not pro bono according to Newsweek, Jan. 18th, 2024 report. Past cases were funded by PACs.

"There were 28 disbursements made to Habba's law firm, according to the FEC, all categorized as "legal consulting." Save America's 16 payments made up the bulk of the funds, totaling more than $3.48 million, while Make America Great Again's 12 donations gave Habba $110,728. The largest payout was made July 1, 2022, in the amount of $486,085.28."

With regard to Trump's case against the New York Times, Dr. Mary Trump, and Hilary Clinton. The court found it frivolous and, in a January 2023 ruling, required Habba and Trump to pay nearly $938,000 to the defendants in the case.

Trump seems not to have used his money, as there is no mention of his personal disbursement for the trial(s), though he may have, and it isn't public info available like the FEC data.

A couple of days ago Judge Barbara Jones (Ret) wrote to Judge Engoron. She was appointed by the court 14 months ago to monitor the Trump organization's compliance with acceptable accounting rules. Her findings are devastating and detailed. Two observations: Firstly she found that the organization still managed by Trump and his two sons had changed their previous methods sufficiently to acknowledge that their previous practices were wrong. Secondly, she determined that inter company loans within the Trump organization were still being used (14 months after her appointment) to balance the books, and further that many of these loans either lacked adequate security or sufficient evidence of the existence of any security or proper valuations. I would be here all day if I went into detail but now believe that my previous estimate of $250/300M may be woefully inadequate and a Judgement approaching double that is a real prospect. Bonds for an appeal usually require cover for the full court award +20%. So if these two cases were aggregated in a worst case scenario for Trump, he could require a Bond of M$500 +100(20%)+83(+20%) a total of $696 million.

A Bond of this magnitude for an acceptable risk would cost approximately $90 to $120 million. IF there is a willing Bond issuer.

In the circumstances, Ms Carroll might not be cashing a cheque any time soon, but to my mind insolvency of the Trump organization may be a very real question for consideration very very soon.
