I'm in complete shock....

One not so outstanding kink group in our community sent people into a kink group I'm aligned with to secretly video tape the goings on, then met with news media and gave them the recorded video. A local news station is airing a story about a "suburban bondage club" on the 10pm slot. On their teaser you can identify one of my friends... People I care about are going to be outed...

This is terrible! Is it even legal? I thought you had to give consent to be shown on tv?

So. As long-hated and feared groups insist on being treated as humans, kinksters are the new safe place to purge?!? I thought that the one good thing "50 Shades" did was make it plain that kink is a Thing That Humans Like, and your neighbor can't come to the door because she is tied to the bed.

What despicable "journalism," equating news with eyeballs, no matter who it hurts.

Actually, this isn't new. I'm sure it happens more often than we care to think about. Just this year on my local news a pro domme was outed. She owned a house in the suburbs that she lived in and had a second house in the same subdivision that she used for meeting with clients. The moral outrage from concerned parents was apparent in every interview the news did with neighbors. "I had no idea this was happening! I have children!"

I'm sure that her business has been ruined. The journalists themselves started researching if it was legal to operate a business from the house and what kind of licensing she would need if what she was doing was in any way legal. They made clear authorities wanted to shut her down as they were looking at it like prostitution.

I imagine even if everything was on the up and up, her clients would probably not feel safe returning because now the neighborhood was fully aware and probably nosy as fuck.
 
I am absolutely positive that there must be some sort of legal precedent, if not a specific legislation, preventing the recording of people's personal lives in that manner. Is it not blatantly voyeurism in conflict with privacy laws? If you gathered enough cash to take the owner to a court I'm sure your people would win.

Until then I strongly suggest mass-emailing the broadcaster and threatening them with legal ramifications of airing the footage with some fancy sounding law jargon. There's no way they don't already suspect that airing it would be ambiguously legal, it might be enough for them to pull it at the last minute. Fill letters with references to potential harassment and/or damage to health and property people in the video might receive from their community, some stuff about infringing on their rights to privacy, etc. They're not a big corp so they probably will be too afraid to risk the costs of a potential settlement.

If you provide the details of the broadcaster we can also all use our social networks of people who would be sympathetic to the cause to do it as well. A hundred emails in quick succession isn't much but I guarantee that it looks damn scary on their end.

Nope. We do not own the copyright to our own faces captured in others ' imaging. Think of crowd photos in stadia for example.

Interesting. I remember an old show called Cheaters, where a man or woman would have their significant others followed around to bust them cheating. Every third show would have the cheaters face blurred out because they didn't sign the waiver. I guess this show just had that rule?


Blows my mind that this can be done to these people. Terrible.
 
I'm just afraid of what this will do to this group. Venues will most definitely have to be changed as well as the usual date each month. I certainly don't feel safe returning until stricter measures are in place for who is admitted. And I hope that those identified get lucky and can retain their jobs, families, etc.

There are several members who can be more open in their kinkiness that are organizing legal action against the news station if they air. I made a trash email account and wrote them as you suggested (thank you for that every legal sounding pm :heart:). And I know many others are doing the same. I'm watching Fet closely for further developments.
 
libel/defamation is only relevant if the report is false.

I'm not sure what legal actions can be taken. But in order to enter this particular gathering you have to read and sign a page that lists the rules. One of which states no use of phones or recording devices. They had to sign that sheet and show a photo ID in order to enter. So the person who recorded the video I'm certain can be charged with something.

MD - hugs hugs!!! What a heartache of a day. I sent you a message on fet life about a group called the National Coalition for Sexual Freedom. Not sure if they can help but we've had similar situations in our community and remember their name coming up.
