Mistaken identity results in Attempted Implied Non-Consentual Sex

The problem here is that the guy broke the law and even though it was quite serious (intended rape) he is getting a reduced sentence. The victim has to live with the fact that someone tried to rape her. The guy might not have been a criminal before but he is NOW.

Quite frankly, whether or not the guy went to fulfill a fantasy THEY BOTH HAD - he was wrong. What if the girl didn't fight back and was scared, what if when he hit her, he knocked her out or worse killed her? Unless we hear differently that through police invesigation they find these emails - it could be just a story he made up.

I hate to say this, but for all the men who are reading and replying to this thread, what if it were your sister, or mother, your girl-friend, cousin - any woman in your life? Would you still feel that she should shrug it off? Don't you think she would be scarred for life? Even more so, wouldn't you? Wouldn't you want to get out there and beat the shit out of that guy who did this to someon you loved? So, honestly, wouldn't this scar you in some way?

It's certainly possible. And, as I was trying to illustrate in the example of an allegedly staged kidnapping, were it to happen to me, I'd feel quite scared, in danger of my life etc. Hence, in all but the most convincing cases of mistaken beliefs coupled with genuine diligence about ascertaining consent, I say there's a crime; it's against society; the committer should pay. (My emerging from the kidnapping without physical harm is a small mitigating factor, perhaps.)

I think the ignorance here is the fact that, if those people staged a rape fantasy, perhaps it would have been smart to know what each other looked like. Yes, yes, I realize that would not happen in "real life" - but look what did happen - the outcome of this rape fantasy.

When couples stage fantasizes at least they know each other -- it may still be exciting to them when it is done at a time that is not expected, but when they turn around, they see a familiar face.

Am I making sense, here?

I can't say I feel sorry for the guy -- I mean, it is an unfortunate thing to have happened to him, IF it were a case of mistaken identify. But, if he is a rapist - he should be made to pay.

I've had a couple of girlfriends who wanted to be raped. There was something seriously wrong with each of them. Although one should certainly have been worth the effort in some ways, I didn't find it a satisfying experience. Outright consent reduces the value of the fantasy for them. They want to do it all with inuedno, so as the fantasy rapist you worry whether you are being set up by some weird form of femminazi. It's not a pleasant experience at all if you are half way normal.

This guy was stupid to go to this length, but how much jail time should he get for being stupid? After all, at least he didn't try to colonise Mesapotamia.
