If the ineffectual defence continues to represent them, do they have someone neutral to tell them whether their defence attorneys were incompetent? Unless they're literally sleeping on the job, would the lay person know they'd cocked things up?

Can/should the judge call for a retrial if they think the defence is a buffoon?


I've not heard of a judge granting a new trial sua sponte solely on the basis of ineffective assistance of counsel. Not saying it couldn't happen, just never heard of it. Don't know about Cali., but here everyone receiving a death sentence has an automatic appeal to the Court of Criminal Appeals - our highest criminal court. The problem is that when there is overwhelming evidence of guilt to support the conviction, merely showing ineffective assistance probably won't get you there. If they think they have a constitutional grounds for appeal, they get to try to take that all the way to the Supremes if they don't make it at the Federal District level. Caveat - I never practiced criminal law, and haven't looked at the Code of Criminal Procedure in 30 years.

I'm not low income or low skill though.

I lived quite well there for several years and made quite a nice sum on my way out.

I just found a better deal than what California was offering. Minnesota gives me more for about 1/3 the price.

13% of the cases who try it are told they have a shot. You have to remember that you don't get the appeal if you make an Ineffective Assistance of Counsel case, you're just using that as evidence for an appeal. You have to go before what is essentially a tribunal to prove that the ONLY reason you lost was because you had a bad lawyer. You're not acting to be set free, you're asking for a new trial with a decent lawyer. You're trying to prove you have grounds for a new trial. So it's not like the 13% of people who were told their counsel's assistance were ineffective actually got their new trial, and none of them got released.

If you want any kind of stats on wrongful imprisonment, the Innocence Project and the Exoneration Project are both really good places to go. They're not-for-profits who are dedicated to helping people fight the prison system and I've worked with both of them a lot. I know there are others, Legal Aid of the Bluegrass is another one, but like for stats and research Innocence and Exoneration are the way to go. Most of the other places don't offer holistic resources somuch as individual aid.

Part of the problem is that most people on trial clearly did it. Most people understand this so the presumption of innocence is something that we mostly give lip service to, but don't actually believe. We refer to people that are not convicted at trial as having "gotten off."

Look at the thread on Manafort. A pretty firmly self-identifying "progressive" is arguing that he "knows" Manafort is guilty because he was convicted and sentenced and is unwilling to concede that if the indictment only happened (as it also did in the Zimmerman case) because of blatant prosecutorial misconduct that occurred, that is of no consequence. BoyNextDoor goes further and insists that a blatant miscarriage of justice, if a guilty verdict is rendered is, in his words, due process, when that is the opposite of due process.

It is an uphill slog to unring the "guilty" verdict.

Most people think that the Enron executives were "guilty." They very well may have done the things we all believe them to have done. As s matter of law, they were not guilty. Their convictions were reversed on appeal for blatant prosecutorial misconduct.

In all of the above mentioned cases (as well as most of the cases you will find where the innocence project or other interested parties get a conviction reversed) none of these prosecutors who should be in jail for what they have done have even lost their license to practice law and to go ahead and do it to someone else.

There's an old saying that anyone who acts as his own dcotor/accountant/lawyer/fill in the blank... has a fool for a client.

In legal parlance the phrase for this is 'propria persona," it's interesting that a lot of Judges will practically not let you represent yourself. They will insist that you at least have co-counsel at your table even if you want to speak for yourself.

Their reasoning is that they want to make sure that they are not reversed because you did not have adequate counsel and by definition if you're not an actual lawyer theoretically you don't habe adequate counsel. Representing yourself you can be assured that you at least have highly motivated Council which sounds like more than your original post got.

I don't know what the stats are but from what I understand that is almost always a losing proposition. It also doesn't help you very much on a peel even though you would think it would.

Seems to me that a lot of jailhouse lawyers do a fairly decent job at getting their appeals heard once they learn how to navigate the system. They obviously have lots of time on their hands and I wonder if judges don't hear such a peel sometimes just for the fun and Novelty of it.

It's worth remembering Dolf that you cannot in your country, the UK, sue a barrister for incompetence at all. At least that was the case a few years back - it may have changed.

I already said that this wasn't posted as a competition between justice systems. I'm just curious about how it works, how people feel about it, and if public perception is accurate. I'm more interested in facts than comparisons.

The British system is a lot easier to discuss offline, frankly. Because I'm surrounded by Brits.
