BTW, the estate of Issac Hayes filed for an injunction against Trump playing his music at rallies. The hearing is set for Sept 3d.

The critical issue, I believe, is whether an individual music artist can overrule the music industry licensing organization which grants rebroadcasting licenses and whether that denial of use applies to ALL licensees given licenses by the organization, but only when Trump is involved.

Basically, can an artist force the licensing org to deny use of their music to one individual who has a license just like every other broadcaster and also make that applicable to all other licensees but only in regards to that one individual?

I'd think that fair use, the license, and a contract with the licensing org would defeat that theory but it's really going to depend on how liberal the judge is and whether he allows his politics to influence his legal decision making.

When challenged, he called people "stupid".

Now he's doubling down on his derp, insisting that artists have no "right" to restrict music licensing organizations because the music licensing organization controls performance rights.

Fair Use does not apply. The license contains specific verbiage to disallow artists' songs from being played at the political events of any candidates they do not like. The "contract with the licensing org" WOULD apply, just not in the way you believe. And the personal politics of a "liberal" judge has no bearing on contract law.

The only reason I suspect that Hayes' estate is suing at all is that this was never really an issue until fringe candidates (Trump) began misappropriating copyrighted material for their own benefit.

Perhaps Hayes' music was subject to a performance contract from a kindler gentler era, when licensing agencies didn't have to include specific prohibitions against performance at political rallies.

In any event StoopidArpy, as shown above, does not appear to have a very good understanding of the performance of copyrighted music at political events.

In the universe called reality, Libertarians have a choice. You can not vote at all and we all lose. You can vote 3rd party and lose the election but keep your Libertarian ideals as we all swirl down the drain together. You can vote for the Democrats and lose your honor, your ideals, and everything you've worked hard to get in life. Or you can vote for Trump and hope he can fix the mess Biden/Harris made of everything.

It's your choice, but the trolls and Democrats are going to go crazy and try to convince you that black is white and up is down just so you don't vote for Trump. They don't care what other vote you cast, or even if you don't vote at all, as long as you don't vote for Trump.

Which should tell you how afraid they are of you and me actually picking who we want to lead our country.
