Interesting... I don't know enough about American law to have an opinion on this, but it's an angle that hadn't occurred to me.

"Performative" - he literally had Venezuelans on a plane immediately after invoking the act and then his admin openly stated that they were ignoring the court order.

The people in this photo were residents of the USA that were denied due process. They were rounded up and shipped to a prison in El Salvador—without trial, without evidence—simply on suspicion of gang affiliation.

This was done in defiance of our American courts that deemed the action illegal.

They could be legal residents. They could be innocent bystanders. They could be asylum seekers. For all we know, they could be U.S. citizens.

Now, they’re trapped in one of the most violent prisons on Earth, enduring brutality beyond what most of us can imagine.

In most 1st world countries, the military is under civilian control. However, that doesn't mean that the military is subject to civilian law. Basically, no court has the power to tell the military not to go to war.

The court in this case overstepped because it believes that it has the power to command anything merely because it believes it has that power.

The invocation of the Alien Enemies Act is void ab initio. There is no war. There is no enemy, save Russia. A government does not declare war on a crime gang.

As such, under the AUMF, the President has the authority to military powers against those declared as terrorists. One of those military powers is the Aliens Act.

In the end there's a simple thing happening here. You, like most lefties including Judge Boasberg, automatically assume that Trump cannot do something. Then you back and fill trying to justify that assumption despite the law.

That's not the way it works. As is being shown by all the suits that have been thrown at this administration over the past 50+ days with most of the judicial orders being blocked by higher courts who actually understand that the judges are overstepping their authority when they issue orders to restrain the government.

Noticeably, when the reversals of those orders happen the only response we get from you; is silence. Which is followed by more crowing about how Trump is being sued for using his Art II Constitutional powers. And then more silence when those suits are ultimately tossed aside like the trash they are.

It's almost like none of you bastards learned a thing when the courts ruled about Presidential immunity and how that applies to Trump's actions in his prior administration.

The courts will rule. It is in their powers to rule, since the question isn't about the war act itself. But whether the president can enact it under the constitution.
There is no "declared" war, or threat of invasion.

Though us Canadians are thinking about it. Maybe go invade the wast coast and west coast states and take em over. Should be an easy victory since most of the residents are Democrats...*chuckles*
 
The only reason the order is being used is to sidestep due process. Courts certainly see right through that.
The reason is we have enemy aliens in our midst. Relevant legal text (50 U.S.C. § 21)

"Whenever there is a declared war between the United States and any foreign nation or government, "or" any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation thereof, all natives, citizens, denizens, or subjects of the hostile nation or government, being male of the age of fourteen years and upwards, who are within the United States and not actually naturalized, shall be liable to be apprehended, restrained, secured, and removed as alien enemies."

It also allows enforcement if the U.S. is invaded or threatened, which does not necessarily require a formal war declaration. All that is required is the president issue a public proclamation for the law to take effect.

I have. The President can deport gang members without its use. They are choosing this route to avoid needing to prove their allegations. That is because they are deporting people who aren't gang members.

Due process is not optional, regardless of their citizen status. That is the reason the alien act is being used. It gives the President elevated privileges to ignore due process during times of war. (Which we are not in)
