The Alien Enemies Act - 1798

Did you notice your post said, ". . . you should expect to be tyranted . . . " You're basically admitting that using the powers of a tyrant is OK with you.

Careful what you wish for . . .

I have no issue with duly elected representatives using the powers bestowed upon them by the Constitution.

My question is why are you so scared of it? The powers exist and are within the Constitutional authority of the President. Using those powers to quell societal unrest and catch criminals is perfectly legal.

Or don't you know how police operate when it comes to sting operations?

It would be interesting to watch that play out in the media (assuming the Trump Administration didn't do it all in secret). Imagine the Attorney General being asked to explain why a federal judge was arrested under those circumstances!

I think Bondi would be a super star if she did it.

Conspiracy to overthrow the Government, Sedition, and we're seeking the death penalty would be a great place to start.

Keep in mind though that once a country started down this path, the legal system becomes obsolete and unneeded. Not that it would matter much to a "semi-retired" pettifogger such as yourself, who hasn't set foot in a courtroom for over half a decade.....

‘Over the past week, the Trump administration has dramatically intensified its implementation of a presidential dictatorship. It has seized and detained individuals for exercising their First Amendment rights, invoked the reactionary Alien Enemies Act of 1798 to deport hundreds of immigrants without due process, and openly defied judicial rulings against these actions.’

The latest target of Trump’s assault on democratic rights

‘Operating on the basis of the fascist theory of the “State of Exception,” the Trump administration is carrying out a deliberate and systematic plan to establish a presidential dictatorship. Each violation of democratic norms sets the stage for even more severe and far-reaching attacks.’

I dont believe that dummy ever went to law school, but if he did, it would be one of those matchbook correspondence “schools”

He’s far too stupid.

No need to make more work for the courthouse housekeepers.

The fun part that everyone misses is that EVERYONE in the room who doesn't have pre-clearance gets arrested. The court clerk, the transcription clerk, the bailiff, any of the buddies of the bailiff who show up after the judge pushes the emergency button, EVERYONE.

You know who is going to roll over as soon as the DOJ offers a deal to drop their charges if they rat out the judge?
It's obvious why your law practice can only take on two-bit money-grubbing cases. You are way out of your league on Constitutional priorities.

I don't. The court has the right to review...as does the legislator. This President is throwing shit at the fan to get away with shit he shouldn't be. Autocracies don't belong here.

We aren't at war. Venezuela is not engaged in hostile action against the country.
The Act doesn't require a declaration of war. Also no federal court can review an action taken under the Act. That's not me saying that but the SCOTUS:

Ludecke V Watkins 335 US 160 (1948)

MR. JUSTICE FRANKFURTER delivered the opinion of the Court.

The Fifth Congress committed to the President these powers:

"Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being of the age of fourteen years and upward, who shall be within the United States and not actually naturalized, shall be liable to be apprehended, restrained, secured, and removed as alien enemies. The President is authorized, in any such event, by his proclamation thereof, or other public act, to direct the conduct to be observed, on the part of the United States, toward the aliens who become so liable; the manner and degree of the restraint to which they shall be subject...

"The act concerning alien enemies, which confers on the president very great discretionary powers respecting their persons," Marshall, C.J., in Brown v. United States, 8 Cranch 110, 12 U. S. 126, "appears to me to be as unlimited as the legislature could make it." Washington, J., in Lockington v. Smith, 15 Fed.Cas. No. 8448 at p. 760. The very nature of the President's power to order the removal of all enemy aliens rejects the notion that courts may pass judgment upon the exercise of his discretion. [Footnote 7] This view was expressed by Mr. Justice Iredell shortly after the Act was passed, Case of Fries, 9 Fed.Cas. No. 5126, and every judge before whom the question has since come has held that the statute barred judicial

review. [Footnote 8] We would so read the Act if it came before us without the impressive gloss of history.

So which foreign nation, or government is doing any of the bold portion of your text.

See the problem, citizens are not "nations" or 'governments".

Fuck you're stupid.

Maybe. But at least I have an idea on how to fix the mess Boasberg and the other rogue judges have made.

You, not so much. All you do is whine and cry and kick your feet that the nasty MAGA's are doing things you don't like.

^ someone hasn't been following the news.

There have been tens of thousands of "military aged single males" from China. Millions of the same from Mexico and S. America nations. More from shitholes. Even more refugees from the Middle East who ascribe ONLY to Allah and Muslim law over US law. They are criminals, rapists, murderers, gang members and then some.

These aren't poor starving women with children who are being persecuted in their home countries, they're SINGLE, MILITARY AGED, MALES who are fit and well fed and who come from nations which are avowed enemies of the US. They chant Death To America in OUR STREETS.

And you protect them over your fellow neighbors and citizens. Because why exactly?

Boasberg is doing his job. Asking for information and facts doesn't make him rogue.

Your opinion is wrong and you don't know what your espousing.

So what? We have competing "wrong" opinions. That doesn't make yours any better than mine. Nor does it make your opinion the correct one.

Basically, you failed and still can't get it up.
