It wouldn't be Unconstitutional to use the military like that. It would be interesting in practice to see what the Supreme Court would say about the Marines. The Posse Comitatus Act which what I'm assuming you're referring to specifies no Army and as of 1956 no Air Force. And by 1956 the Marines were established and well known so it's plausible they were ignored intentionally. (I doubt it to be honest, I think they were simply neglected and it should read US Armed Forces or whatever the technical term is that refers to all branches) but hey I didn't write it.)
