to asphyxia from sustained forceful pressure. Full statement:

— Benjamin Crump, Esq. (@AttorneyCrump) June 1, 2020

"George died because he needed a breath, a breath of air," Floyd family attorney
Ben Crump said during a news conference Monday. "For George Floyd, the ambulance
was his hearse."

The Hennepin County Medical Examiner released a new autopsy report Monday,
ruling George Floyd's death was a homicide. The office said Floyd's heart and lungs
stopped functioning "while being restrained" by law enforcement officers.

Floyd died due to "cardiopulmonary arrest complicating law enforcement subdual,
restrain, and neck compression," according to the report.

It also specified "other significant conditions," including fentanyl intoxication a
nd recent methamphetamine use as well as existing heart disease.

In charging documents released last week, prosecutors said that preliminary results
from an autopsy "revealed no physical findings that support a diagnosis of traumatic
asphyxia or strangulation."

However the new report from the medical examiner did not include such language.

Minnesota’s attorney general to charge three more officers in Floyd’s death — and upgrade murder charge

Minnesota’s attorney general will elevate murder charges against the former Minneapolis police officer who kneeled on George Floyd’s neck until he died, and will charge the other three officers involved in the in-custody death.

Attorney General Keith Ellison will charge Derek Chauvin with second-degree murder, and former officers Tou Thao, Alexander Kueng and Thomas Lane with aiding and abetting murder, sources told the Star Tribune.

About time Keith.:)

‘There is great distrust of the entire system’: CNN reporter says protesters want the Hennepin attorney to resign

On CNN Wednesday, correspondent Miguel Marquez reported that while Minnesota civil rights activists will approve of the upgraded charges against the police officers involved in the death of George Floyd, they also want accountability for Mike Freeman, the Hennepin County Attorney who initially declined to charge every officer.

“Those protesters will be pleased, absolutely happy to hear these charges have now been brought, but they will want more,” said Marquez. “Specifically, they do want the County Attorney, Mike Freeman, the Hennepin County Attorney, who initially had this case and then turned it over to the attorney general, they want him to resign. They’re also upset with the governor and his handling of it.”

At his press conference on Wednesday, Minnesota Attorney General Keith Ellison maintained that he has confidence in Freeman, and that Freeman will continue to serve on the prosecution team against the officers.

Freeman didn't do his job, and we've had Nation Wide Riots. Cops back cops and Pol's back Pol's just a few errors folks doesn't cut it!:(

I agree

Maybe its time to disband all police departments and let folks just fend for themselves. The police arrest slow down seems to be doing a good job in Baltimore at the moment.

no cops at all. especially in the big cities.

To Make Police Accountable, End Qualified Immunity

In determining the relationship between government and governed, one of the most important decisions a society can make is how accountable those who wield official power must be to those against whom that power is wielded. Congress made a clear choice in that regard when it passed the Enforcement Act of 1871, which we now call “Section 1983” after its location in the U.S. Code. Simply put, Section 1983 creates a standard of strict liability by providing that state actors “shall be liable to the party injured” for “the deprivation of any rights.” Thus, if a police officer walks up to your house and peeks inside one of your windows without a warrant—a clear violation of your Fourth Amendment right against unreasonable searches—he is liable to you for the violation of that right.

But many conservatives do an odd thing: In their preference for a more forgiving policy that gives police and other government officials substantial leeway in the exercise of discretion, they abandon their stated commitment to textualism and embrace an “interpretation” of Section 1983 that is utterly divorced from its text. The vehicle for this conservative brand of what we might call “living statutory interpretivism” is the Supreme Court’s qualified immunity doctrine, which judicially amends Section 1983 to provide that the standard for liability will no longer be the deprivation of “any rights”—as Congress expressly provided—but rather the deprivation of any “clearly established” rights.

This Monday we will find out whether the Court will take the unprecedented opportunity it now has to revisit qualified immunity. It will be particularly interesting to see which self-styled conservatives—on and off the Court—place their stated commitment to textualism and judicial deference above whatever personal preference they may have for continuing our half-century experiment in near-zero accountability for law enforcement.

California cop shoots through his own windshield to kill suspect on his knees — after mistaking his hammer for a gun

A police shooting in the California city of Vallejo has a community on edge, according to a report from NBC Bay Area.

Sean Monterrosa, 22, was kneeling when a Vallejo police officer shot and killed him. The shooting happened while police were trying to stop looters from invading a local Walmart.

“This individual appeared to be running toward the black sedan, but suddenly stopped, taking a kneeling position, and placing his hands above his waist, revealing what appeared to be the butt of a handgun,” Vallejo Police Chief Shawny Williams said.

But Monterrosa was carrying a hammer, not a gun.

“Due to the perceived threat, one officer fired his weapon five times from within the police vehicle through the windshield, striking the suspect once,” Williams said.

Minneapolis City Council taking first steps to ‘dismantle’ police department

“We are going to dramatically rethink how we approach public safety and emergency response,” said council member Jeremiah Ellison. “It’s really past due.”

Aiming to “dismantle” the Minneapolis Police Department, city councilors on Friday will vote on imposing a temporary restraining order for the city’s police department in response to the killing of George Floyd last month, and plan to set a timeline for the state’s investigation into racial discrimination by the police over the past decade.

The restraining order would be the first step in replacing the department with “with a transformative new model of public safety,” said City Council President Lisa Bender on Thursday.

Maybe 12 complaints in as many years will be a subject for "Concern?":)

‘Hit her! Hit her!’ Indianapolis cops batter black protester with batons and pepper bullets

Indianapolis police officers are under investigation for beating a black woman with batons and shooting her at close range with pepper balls during protests against police brutality.

In a widely circulated video clip, officers can be seen repeatedly battering the woman with batons and firing less-lethal weapons as she stands still Sunday afternoon at the corner of North Pennsylvania and East Washington streets, reported the Indianapolis Star.

FBI wanted to separate itself from Barr's tough stance on protests, sources say

"It wasn't Us FBI Says"

WASHINGTON — At a Justice Department press conference on Thursday, FBI Director Christopher Wray sought to clarify how his agents were being used in nationwide protests and make it clear that the FBI is intent on protecting civil liberties, a message he has been seeking to push all week, according to three sources familiar with the planning of the press conference.

"The protectors can quickly become the oppressors, particularly for people of color," Wray said. "Civil rights and civil liberties are at the heart of who we are as Americans."

Wray's stance was distinct from that of Barr, who focused on violence caused by protestors to justify the deployment of federal agents and his authorization of the use of non-lethal force against crowds in front of the White House on Monday.

"They feel a strong need to delineate what they are and are not doing," said a source familiar with internal deliberations at the FBI. "You won't see FBI agents with a baton and shield."

"We ain't the fucking Nazis here!"

NOW THE POLICE ARE TARGETING MEDICS

Police officers have targeted essential workers such as health care personnel and food deliverers, as well as journalists.

Police brutality is wrong under any circumstances, but the instances of medical personnel being assaulted or harassed are deeply troubling.

Police used shotguns to fire bean bags filled with lead pellets at an injured protester and the medics trying to assist him during an Austin, Texas, demonstration.

In Asheville, North Carolina, police officers destroyed a medical assistance tent and the water supplies volunteers brought.

During times of war, soldiers aren’t allowed to attack military medics. It’s in the Geneva Convention, which states: Medical personnel exclusively engaged in the search for, or the collection, transport or treatment of the wounded or sick, or in the prevention of disease, staff exclusively engaged in the administration of medical units and establishments, as well as chaplains attached to the armed forces, shall be respected and protected in all circumstances.

Even in their combat-ready armor, with their combat-style rifles and combat-looking vehicles, police officers aren’t soldiers and aren’t trained like soldiers. But if they want to dress up like soldiers, they should be expected, at a minimum, to follow the same rules soldiers do.

‘Boogaloo Bois’ Busted On Their Way To Las Vegas Protest With Molotov Cocktails

Three “Boogaloo Bois” had big plans for Saturday in Las Vegas. They stopped off at a gas station en route to an anti-police protest over the death of George Floyd, and filled up a gas can. They had begun making the Molotov cocktails they intended to launch into the crowd of protesters when they suddenly found themselves surrounded and arrested.

The men, all with military backgrounds and a devotion to far-right “Boogaloo” memes, were charged Wednesday by federal authorities with plotting to attack the protest in order to further their hope for a civil/race war, Nevada U.S. Attorney Nicholas Trutanich announced.

“Violent instigators have hijacked peaceful protests and demonstrations across the country, including Nevada, exploiting the real and legitimate outrage over Mr. Floyd’s death for their own radical agendas,” Trutanich said. “Law enforcement is focused on keeping violence and destruction from interfering with free public expression and threatening lives.”

The men—Stephen T. Parshall, 35, a former Navy enlistee; Andrew T. Lynam Jr., 23, an Army reservist; and William L. Loomis, 40, a former Air Force enlistee—are being held on $1 million bond each in the Clark County jail, according to court records. Parshall and Loomis are from Las Vegas while Lynam hails from suburban Henderson.

Police Board President: Officers Struck Me 5 Times With Their Batons During Protest

Chicago officers struck Chicago Police Board President Ghian Foreman five times on his legs with their batons during a protest on Sunday in Hyde Park that turned violent, Foreman told WTTW News.

Foreman filed a complaint with the Citizens Office of Police Accountability alleging that he was struck by at least one officer during a protest sparked by the death of George Floyd in the custody of Minneapolis police, said Ephraim Eaddy, a spokesperson for the agency.

Foreman’s complaint, which identifies the officer Foreman said struck him, is one of 344 complaints of police misconduct filed with COPA between midnight May 29 and 7 a.m. Friday, Eaddy said. The complaint itself is confidential.

Foreman said he had two bruises on his legs where he was struck while protesting police brutality on 47th Street, not far from his Hyde Park home.

“It hurts bad,” Foreman said, adding that the pain of the bruises paled in comparison with the pain felt by his wife and mother when they learned he had been injured by police.

Philly police threaten to call in sick during protests after officer charged with assault: report

Philadelphia Police Staff Inspector Joseph Bologna has been charged with assault after a video circulated of him beating Evan Gorski, a Temple University student, during a protest. But according to The Philadelphia Inquirer, his fellow officers on the force are outraged — and may stage a “sickout” in protest.

“John McNesby, head of the city’s police union, came to Bologna’s defense, calling him one of the city’s ‘most decorated and respected police leaders’ who had to make a split-second call in a chaotic situation,” reported William Bender and Jeremy Roebuck. “By Friday evening, talk was circulating about a ‘blue flu,’ or organized move by officers to call in sick in solidarity with Bologna, as another round of demonstrations, with crowds anticipated in the thousands, was set to take place Saturday in central Philadelphia.”

“The video shows Bologna … striking Gorski sharply on or near his head and tackling him, while another officer presses Gorski’s face to the pavement by placing his knee on the back of his head and neck,” said the report. “Other video clips have since emerged on social media showing Bologna involved in similarly aggressive behavior toward people protesting oppressive policing.”

The "Blue Flu" may not be a deadly as Covid-19 but it could fuck up your pension plans.:)

What does 'defund the police' mean? The rallying cry sweeping the US – explained

Activists have long advocated taking money from police and reinvesting it in services. The idea is now seeing a wave of support

For years, community groups have advocated for defunding law enforcement – taking money away from police and prisons – and reinvesting those funds in services. The basic principle is that government budgets and “public safety” spending should prioritize housing, employment, community health, education and other vital programs, instead of police officers. Advocates argue that defunding is the best way forward since attempts to reform police practices over the last five years have failed, as evidenced by the brutal killing of George Floyd. Groups have a range of demands, with some seeking modest reductions and others viewing full defunding as a step toward abolishing contemporary police services.
How much does America currently spend on police?

In the past four decades, the cost of policing in the US has tripled and is now $115bn, according to a recent analysis. That steady increase comes as crime has been consistently declining. In most cities, spending on police is significantly greater than spending on services and other departments ($1.8bn on police in Los Angeles, for example, which is more than half the city’s general fund). The Covid-19 economic crisis has led cities and states to make drastic budget cuts to education, youth programs, arts and culture, parks, libraries, housing services and more. But police budgets have grown or gone largely untouched – until pressure from protests this week.

City of the Angels my ass! LAPD isn't the MOST racist but maybe as corrupt as Chicago PD.

California man cut himself and then concocted a story about being attacked by Black men: police

A California man has been released from custody Saturday after he cut himself and then lied about being attacked by two black men, the Daily Press reports.

Twenty-five-year-old Daniel Davis of Hesperia faces at least one count of making a false police report of a crime. Davis’s actions are being considered a hate crime.

Davis initially told police he was driving on a road “when two vehicles boxed in his car, forcing him off the highway.”

However Officer Friendly investigated!:)

But after detectives looked into Davis’s claims, they determined the very next day that he was lying.

“Davis had concocted the entire incident for personal reasons, damaging his own vehicle, and caused the injuries upon his own person,” Sheriff’s officials said.

Virginia man who plowed his truck into Black Lives Matter crowd is the head of the state’s Ku Klux Klan

Over the weekend, a Virginia man was arrested for driving his truck into a crowd of protesters. It has now been revealed that the accused, Harry H. Rogers, is also the head of the Virginia chapter of the Ku Klux Klan.

WTVR News reported Monday that Rogers was charged by police with attempted malicious wounding (a felony), destruction of property (also a felony), and assault and battery (a misdemeanor) after the incident. When he was arrested, Rogers confessed to officers he is the president of the Ku Klux Klan in the state and claimed to be the highest-ranking member of the Klan that is not in prison.

Officer Friendly seems to have fixed that! Aha ha ha ha!:D

‘One less thug!’ Trump-loving Minneapolis cop under investigation for posts celebrating police brutality

A Trump-loving Minneapolis police officer has landed under investigation for a series of racist and inflammatory social media postings.

Officer David Peña, who goes by “Dave Rock” on Facebook, celebrated the police shootings of black men and shared disinformation about protesters, reported City Pages.

“FYI all our personal info was leaked by someone in the department,” Peña posted Friday, in apparent reference to possibly fake data breach. “Word is that protesters are going to our houses. Lock and load!!!”

Peña celebrated the killing of 21-year-old Dreasjon “Sean” Reed, who witnesses say was fatally shot in the back May 6 after an Indianapolis police officer used a Taser stun gun to knock him to the ground.

“Good riddance!!” Peña posted. “One less thug!”

However:
The police department told City Pages that internal affairs was investigating Peña’s posts.

“Thank you for bringing this to our attention. This does not meet the mission, values, and goals of the Minneapolis Police Department,” said spokesman John Elder. “We have launched an internal investigation.”

Indeed, one less thug, on the MPD!:)
