Does This Make Me A Rapist?

I also believe that there is a law where someone could be proclaimed adult. Meaning if you are caught killing someone, they could declare you an adult and be tried as an adult.

So I think if you're sued, you could sue the boy back (although sue would be a wrong term, er I don't know, proclaim he's an adult already?) and if you could prove that he knows what he's doing then I believe you could win the case. ;)

Statuory rape can only be convicted if their is absolute proof that it has been comitted, for instance if there is an eye witness, or the 16 year old gets pregnate. if there is no proof then there is plausable denial since sex is a hard thing to prosicute because it is a 'private' matter and you have the right to Not share your private affairs. Most lawyers wont take the case unless if there is absolute proof (she is pregnate) thats why you often hear of stautory rapists being men because the little girl got knocked up. rarely do you hear of women being prosicuted, although ive heard of a few, (most of the time it was mom walked in when the old neghbor was going down on my little boy.)

First of all, another spin on what "consensual sex" is. Sex between two people who can legally give consent. A minor cannot legally give consent for most things. However, the actual age of sexual consent varies by state/province.

Secondly, no eye witness or impregnation is required to prosecute these sort of scenarios. Case in point : A mother finds out that her 15 year old daughter is having sex with her 18 year old boyfriend. She was not an eyewitness nor was the girl pregnant. The mother, however, did find a used condom in the trash (actually, that didn't flush all the way down the toilet.) She brings her daughter into the ER as a victim of "sexual assault," all the while preaching to
her daughter that she shouldn't be having sex. She brought the condom to the ER as evidence.

Had she chosen to pursue it (which she full well could have, being the parent of a minor), the boy could have been convicted based on DNA evidence. The girl didn't have to press charges; the mother, being her legal guardian, could have done so without her consent or permission.

The guy would have been a convicted sex offender, something that would have followed him around for a long time, if not for the rest of his life.
 
I've never understood the stautory rape thing you have over there. Here, once you reach the age of consent (16), and providing your sexual partner is also at least 16, it doesn't matter what the age difference is; 16 with 16 is viewed the same as 16 with 60 in the eyes of the law (public opinion is a different matter, of course).
 
I think that the theory is that a much older person has a built-in ascendency over the younger one. But really, you can't protect people indefinitely. Otherwise, you risk running into a situation where you could theoretically prosecute a savvy man for taking advantage of a naive woman his own age. We can judge hell out of it, but prosecuting, unless actual fraud is involved, verges on the absurd.
 
Just to throw my $.02 into the ring. I've known 13 year olds mature enough to handle sexuality (NOT many and not KNOWN in -that- sense) and 30 year olds who should really wait for, oh, another 30 years.

Age is, unfortunately, the easiest measure of maturity, even if it isn't accurate all the time.

Sorry if this is a repeat of another post, but that's my opinion.

I'm going to ignore the general rape issue of this and just let you know an interesting fact.

In australia the laws are very bias. For a guy who is over 18, having sex with a consenting girl under 17 is still rape in the eyes of the law. Yet a girl who could be 45 or 22 can have sex with a guy who is 13 and up without any laws to stop it.

I just did a little research on this because I was told this was true and thought they were pulling my leg. Someone convicted of statutory rape not only goes intothe sex offender registry, but the registry of PEDOPHILES!

I'd suggest you google the laws on that subject in your state, and while I don't conndone sex with any minor just read the laws then you'll know what the consequences are but if you really have the hots for him wait until he's 18
then you'll know if it's just a passing fancy or he really wants you at least you'll be safe from some over zealous DA that wants to use you to further their career :cool:

That's just crazy, can that be true? The definition of a pedophile is someone who is sexually attracted to prepubescent children. A randy teenager is not a child and an attraction to him or her is not pedophilia.
 
here where I live the consenting age is 16, yet her parents can prosecute. so it's best to leave them alone, it's too much of a hassle and we live in a society that right now is all about making someone pay. anyway it's not worth it to mess with a young gir,l or if you're a woman, a young boy wait till they get grown and if they lose interest by then it was just their hormones reacting. I love women but lately they act like they want younger men so I guess I'll be jerking off till I die . I refuse to mess with a young girl :eek:

Let's face it if they're under the consenting age you can be prosecuted If you gotta mess with someone that young know the laws in your state and if they push they can label you as a pedophile or sex offender or worse. your best bet is stay away from kids.

I ain't mad at ya, I just hope you never get in trouble like that, once they get you in the system they mess with you, for years. I knew this woman she was 25 and she was having sex with a 17 yr. old. He beat her,took her car and wrecked it. She had him arrested, but by his family having power in the community, and a damn good lawyer they put her in jail for contributing to the delinquancy of a minor and as a result when she got out she lost her job
and couldn't get a job in her town for three years. So if you must just be careful
 
Most states consider "it" rape if the age difference is greater than 2 years. So if you are 18 and he is 180+ months, you will likely get off as being is a consenting relationship, but don't count on it without checking on the facts

If the mother wants to push it, you end up with jail time and on the sex offenders list. ^Shrug^ it's your life, but you asked for opinions, and you are getting opinions.
