I understood what you were saying, but the political circumstances were not the same as the scenario you put forth. And quite frankly, Manchin aside, I think Biden is pissed off enough and vindictive enough to do nothing re. any appointment. He seems to have figured out that his own party is the enemy and if he hasn't Jill damn sure has.

Certainly today's world is different but the principle remains; Biden can do an interim appointment and Congress will have no choice but to confirm the fait accompli after it returns in January.

Congress in the last few years has not recessed completely over the holidays in order to prevent this from happening. That doesn't mean they will continue that trend.
