Biden CAN invoke the Insurrection Act and send regular military. The only quick response unit the Army has is one Battalion of the 82nd Airborne. (18 hours from call up to on the scene.)

2. The Texas Guard consists of 1 Infantry Division with all ancillary support units. 1 Armored Brigade with support units. 1 Fighter Wing, 1 Attack Wing, 1 Airlift Wing with tankers and some ad hoc Special Warfare units.

I hope Biden's handlers don't do something stupid just to flex their muscles while hiding behind desks.

The National Guard can be called to federal service ANY TIME the federal government deems it necessary and requires their service. Texas's right to self defense goes back as far as when Texas agreed to become a state. At that time the fed agreed that Texas's state sovereignty would be protected by the federal government. Recall that Eisenhower in 1957 simultaneously federalized the Arkansas National Guard and deployed the 101st Airborne Division to enforce the law in Arkansas.

It's a response to whomever was discussing the CiC placing Texas NG into title 10 activation status. Texas NG is currently deployed under title 32 defending Texas from an invasion. How ridiculous would Biden appear if he mobilized an already mobilized NG, ORDERING THEM TO STAND DOWN FROM DEFENDING THEIR STATE.

Constitutionally speaking it's untested but I would put my money on Texas.
 
I'm thinking the best thing Joe can do is ignore this whole farce. Go on with other business and the the Pubs and Yabbut expend resources.

The bigger question that remains is what will Roberts do about a state refusing to comply with a court order.

They aren't refusing to do anything. The court order didn't require them to do anything. It just said that the feds can cut the wire fence.

Well, actually it just removed an injunction against the feds from doing so.
 
If there was another civil, my bet is on the side that thinks everyone should have guns for their own protection and safety, especially when up against the other side that is scared of guns and thinks no one should have them.

It hasn't been tested but there are some who would likely say that it would be an unconstitutional order and refuse to obey. Some, not all. The only option should it come to pass would be to attempt to arrest any persons trying to order the Tx NG to stand down or evac the park/border.

This potential problem is being worked around as we speak. The BP is publicly declaring they stand with the Tx NG and they have no plans to attempt to dismantle the concertina wire as well as governors of other states sending their NG to Tx to take their place along the border should the stand down order be issued.

Beyond that:

Biden ordering the army to go in and seize the Texas NG and anyone else they deem part of the insurrection would definitely be an unlawful order. Assembly on State land is not illegal. Nor is non violent patrol or occupation of the border. A military unit obeying the orders of their commanding officer/governor to deny access to State property from non US citizens is not engaged in any action against the State or Federal Government. At best it is a civil matter and therefore there is no basis to use military force to remove the NG from their encampment. Posse Comitatus applies here. Any officer or enlisted obeying such an order would be subject to courts martial and possible execution for insurrection against the State of Texas if found guilty. Basically this type of order is a roadmap to hell and anyone traveling on it is a fool. However, as we've seen in the last 4 years, this admin and its military leadership is filled with fools.
