My point is they didn't arrive at those articles with a DOJ Special Counsel operating under the current law. The House conducted it's own investigation. Mueller had only one job., to find cooperation between the Trump Campaign and the Russians, as soon as it was ascertained that no such cooperation occurred the investigation should have ended right there. It didn't because Mueller, who employed nothing but Democrat supporters of Hillary Clinton to his legal team, wanted a political win on alleged Obstruction, which could not exist without an underlying crime, hence the political wishful thinking and hemming and hawing in Volume II.

there are two legitimate avenues for redress if in in this case, infractions have occurred.

one is purely legal with all the strictures inherent
the other is almost purely political - with greater legitimate latitude.

hence 2 parts to the document.

while practice, procedure and precedent may preclude action in the first part - i.e. a sitting chief executive cannot be indicted,
the political realm - the one covered by the "boring" part without "legal significance" is wide open...

hence current political turmoil.

to dismiss the turmoil as somehow illegitimate is naive
and antithetical to a constitution that

To indict a sitting president has untested theory within the constitution ( special circumstances ). I don't believe any observations from individuals here concluded that political turmoil was illegitimate nor antithetical. However turmoil for the sake of turmoil is divisive and is not effective leadership nor a way to govern.

Being that a special council's governance and findings falls under the auspices of the AG and not any congressional body, then volume 1, which was found statutorily free from crime the publication of the document was not an obligation of the DOJ and volume 2 never becomes a reality.

I believe, to continue the investigation from vol 1 into vol 2 after finding vol 1 to be statutorily clean is in itself judicial overreach. Using the department of justice for political gain or to express an opinion in a subversive attempt to arm congress to facilitate an attempt to impeach and depose a sitting president should be criminally prosecuted. I have never seen a criminal investigation deliberated based on opinion or allowed to continue after the findings concluded nothing of consequence.

It seems we conflate court proceedings with special council. That is why impeachment is so difficult. Indictment of a sitting president still has not been proven at the SCOTUs level i.e. a president shoots somebody dead, is there a procedure to immediately indict bypassing presidential article 2 powers which allows the AG to act independently of the executive branch, maybe, it's not tested. It always seems to come back to " is anybody above the law" I don't believe our framers intended that to be the case.

The establishment of this special council was based on a politically toxic environment, a DOJ, FBI, NSA, DNI poisoned by a hatred for a duly elected president. The scales of justice are supposed to be blind, not in this case. The recusal of a sitting AG allowed a subordinate to dictate the parameters of the investigation, although appointed by Trump it was not his selection for AG. To have an AG recused through this whole debacle is not fully representative of the president of the United States and allowed this investigation to get out of hand because of how the instruction were written. The executive branch was effectively left out to dry, handcuffed for fear of reprisal for interference, hence, Trump protesting the proceedings for self defense because his AG was out in left field and a AAG politically toxic, hence obstruction of justice allegations. What a shit shute.

I guess I compare the Mueller report as to a prosecuting attorney losing his case and the judge renders the case dismissed and the prosecutor goes back to the judge and says "how about this idea" or can we get him on a parking violation.
Peoples lives were ruined because of a justice department run amuck. The scope and latitude given to Mueller was unprecedented and possibly unconstitutional. The consensus politically and media wise was he was guilty without a trial. We all should fear what happened. Don't talk to the FBI without a lawyer for fear of prosecution based on process than an actual crime. What happened to Kavanaugh was a miscarriage of justice and we are experiencing another. Just my humble opinion.

We don't become stronger when the Congress is willing to destroy an AG because he won't break federal law and give them materials they are not entitled to by that same law.
