I think suggesting the Executive branch can arbitrarily define emergencies is not a good look and especially when it's been used to sidestep Congress rather than respond to an actual emergency.

For example, if our GDP and economical metrics are strong, then we clearly aren't in an economic emergency.

I'm not suggesting the courts are the right place to combat this abuse, but I do think Congress needs better guardrails.

All in all, I think the courts are politely giving Congress a nudge to wake the fuck up.

The judge isn't merely being stupid. Nor did I suggest a conspiracy is what's happening.

The judge overstepped his authority, IMO and based on his decision, because he doesn't think the Federal Government has the power to void his injunction in an emergency.

HE decided he has more power than the Federal Government. He's wrong. Not only because a STATE judge cannot decide Federal matters (lack of jurisdiction) but the separation of powers doctrine AND Federal law/precedent strips him of that authority. He doesn't have the ability to tell the Feds what to do because "the power to tax is the power to destroy." (See: McCulloch v. Maryland, 17 U.S. 316 (1819).)

That he did it anyway, despite KNOWING this legal doctrine (he had to in order to pass the bar) only shows that he is intentionally acting against the government for personal reasons. His response to the case SHOULD HAVE BEEN to order removal of the case from State to Federal court. If the claimants refused removal, then his ONLY other option would be to dismiss, with prejudice, because there is no State jurisdiction.

No, they didn't. The oil production can be started up with current pipelines that are already approved. The ones that aren't approved must be approved.

All in all, there is no emergency. As the President said previously, we don't use oil from the strait of hormuz.

But if he wants to admit that he did start a war

Then perhaps he can go to Congress to get authorization for it and perhaps have more credibility for his fake emergencies.
