It hasn't been tested but there are some who would likely say that it would be an unconstitutional order and refuse to obey. Some, not all. The only option should it come to pass would be to attempt to arrest any persons trying to order the Tx NG to stand down or evac the park/border.

This potential problem is being worked around as we speak. The BP is publicly declaring they stand with the Tx NG and they have no plans to attempt to dismantle the concertina wire as well as governors of other states sending their NG to Tx to take their place along the border should the stand down order be issued.

Beyond that:

Biden ordering the army to go in and seize the Texas NG and anyone else they deem part of the insurrection would definitely be an unlawful order. Assembly on State land is not illegal. Nor is non violent patrol or occupation of the border. A military unit obeying the orders of their commanding officer/governor to deny access to State property from non US citizens is not engaged in any action against the State or Federal Government. At best it is a civil matter and therefore there is no basis to use military force to remove the NG from their encampment. Posse Comitatus applies here. Any officer or enlisted obeying such an order would be subject to courts martial and possible execution for insurrection against the State of Texas if found guilty. Basically this type of order is a roadmap to hell and anyone traveling on it is a fool. However, as we've seen in the last 4 years, this admin and its military leadership is filled with fools.
In addition, it would seem from the plain language of the Constitution that the state of Texas itself could go to war with those invading their state over their national border:

No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.

Telling the Biden administration to go fuck themselves is normal. States and the Feds get into this all the time. And it's a good thing because it gives the court a chance to weigh in and settle the matter.

The problem I have is when a state decides the rule of law no longer applies, when they can just ignore the Supreme Court and decide their decision on the disagreement supersedes the decision of the highest court in the land. If we are to stay one nation, then we MUST abide by the laws WE passed. We MUST abide by the decision of the Supreme Court no matter what we think of the ruling. To do otherwise is arrogant, obtuse and just plain stupid.

There are those like the OP that cheer such behavior on without any real concept or understanding of what kind of harm it does. Yeah, we could have a civil war and the country could be broken up into them and us factions, but what then? We would have a lot of independent counties that would be vulnerable to conquest by stronger countries. North Korea, China, Russia, to name a few who would be happy with and take advantage of the dissolution of our nation. It may take a few years, but it would happen.

We need to choose wisely. I don't expect shortsighted and biased individuals like Ish to do so. It takes intelligence coupled with wisdom hitched to concern for something other than yourself to choose wisely. I know Ish and company hate the movie "The American President" because the main character is liberal. But there is one quote from it that has nothing to do with that left/right political line. It's just good advice and WE need to pay attention to it: "We have serious problems to solve, and we need serious people to solve them."

What we don't need is a state ignoring the rule of law because they don't agree with it. What we don't need is a faction in Congress, or State level politicians, with the "my way or the highway, all or nothing, I will not compromise" mindset.

After all that, let me sum up: Texas and those in the US Congress need to get their head out of their ass and do what is lawfull. It's extremely stupid to scream that the administration is ignoring the law, then turn around and do the same thing you are blaming the other side for.

Russia has been stoking this for a while. Much of the motivation is coming from there. Why do you think the MAGAts have been visiting Orban and secretly meeting with him here? He's a relic left over from the Soviet era and supports authoritarianism. Whether of not he is FSB remains to be determined.
