MG, awake from your delusional fantasy world and face reality. I honestly thought we were through with this. But here again, I find myself explaining to a supposedly well-educated individual how the fucking real world operates. Now, “Mr. 10 plus years of higher education”, try acting like a grown-up about this, instead of the “boo hoo waaa waaa poor little cry baby, finger pointing at anybody but me” routine that I have seen so far in your post.

My first question: Why are you singling out Tonie? (Ok yes, so it’s common knowledge that Tonie and I became “better acquainted” during the spring litogether, so you’re naturally going to assume I’m just jumping in to defend her. Well I can assure you, that little lady needs no such help). You singled her out because it fell on her head, at the time, to inform you of what is what. I seem to remember it was a group decision not to invite you back, a group that I myself was a part of. Hey pal, technically this is considered a Private Party, meaning not open to the general public, and as such we can and will reserve the right to invite who we want. It just so happens; you are not one of the ones that we feel we’d like to invite back. And as I read thru the threads, I see many people voicing strong opinions about the matter, not just from the ones planning this thing. So get your thumb out of your mouth, dry your tears, blow your nose, and start acting your age. Damn I have two kids that don’t act this bad, and one of them is a teenager.

So you’re a professor in mass communication. What the fuck does that have to do with any of this? We are talking about Criminal activity. Specifically the use of a Controlled Substance, a.k.a. an Illegal Narcotic in a room designated as the Public Gathering Room for the weekend. You may know communication law, but from what I see you have very little knowledge of criminal law, especially the General Statutes of North Carolina. A few of the things that your little 3-page synopsis does shows us about you is:

1 that you’re a person whom can’t be trusted because of your blatant disrespect for other’s privacy by posting from PM’s (that stands for PRIVATE MESSAGE, not public) which contained names of all involved. Until now, no identities had been revealed to anyone other than the security team, and to the ones planning the next party. We felt that even though they were inconsiderate enough to put several people at risk of possible incarceration, we would still respect their privacy so they could bow out with a little dignity. I guess you fell like a big man now eh? You also betrayed the trust of and showed disrespect for a couple of people’s privacy that weekend when you did your little bragging act. Don’t remember that either? Read on a little further. Maybe you will suddenly remember again.

2 that you admitted to willingly accepting AND using an illegal narcotic in what was designated as the public gathering room. “On the other hand, didn't CNCG know that smoking pot was wrong?” Didn’t YOU know it was wrong? CNCG didn’t smoke the marijuana, you did. I thought you were old enough to make reasonable decisions. I didn’t realize we needed babysitters at these functions due to the steps that were taken to ensure no one under 21 attended. I guess it goes to show, the smarter a person gets, the more ignorant they become, especially where matters of common sense are involved. You say you’re going for your Ph.D? I have a hard time calling someone Dr. when they can’t even show a little etiquette.

3 that you have trouble keeping your stories straight. Point in case: “Also, I had NO idea what had happened earlier w/ the police! As DD could tell ya, if you even bothered to find out facts before jumping to conclusions, I found out the next evening when he pulled me aside and told me. That's when I found out about the police incident for the first time.” changed to “I apologize. Now that you mention it, I remember that conversation in the hallway w/ CNCG and DD. I did give CNCG some good advice 'cause he even thanked me for it the next evening.” Question here. You remembered the following days activities fairly well but didn’t remember CNCG thanking you for the advice you gave to him the night before directly after the police were there? Even making the statement, “I’m the closest thing you have to a fucking attorney here.” Well buddy, if my attorney were like that, I’d have to fire him quick.

You’ve sat here and pointed the finger to CNCG for committing a felonious copyright infringement act, and stated that the marijuana you smoked was a misdemeanor. Did we forget there was paraphernalia involved too? Not to mention that when it was passed to you it then became Intent to Distribute. As to the copyright law of pictures and parodies, maybe you should include in your research the case of “Hustler Magazine, Inc. et al. v. Jerry Falwell” in 1998. That would be as good a place for you to start as any. The Charlotte Police did not come there to investigate CNCG’s use of the AV on a site such as Literotica, they came because they initially knew we were going to be there. They were looking for narcotics, underage drinking, and other illegal activities that are associated with most parties. They only used the excuse of the AV when they could find no other wrongdoing to justify them being there in the first place. If they wanted to specifically go after CNCG on a copyright infringement act, they would have contacted the Literotica site owners and subpoenaed his sing-up information, then contacted him directly, and not even set foot at the hotel. I mean hell man, how many times has CNCG stated he lived right there in Charlotte since he’s been posting in Lit? Let me give you a hint, every time he posts it shows he’s in Charlotte “CharlotteNCGuy” so just look at his post count. Now just suppose there was no parody clause in the copyright laws, even the act would not have put other’s in attendance at risk of being arrested on any charge, only him.

You stated that CNCG’s little dance on the roof would have gotten us all arrested. How? If a law enforcement officer had seen his display, they could have arrested him, and him only, on a charge of Indecent Exposure, and possibly Public Drunkenness. Hell I’m the one who gave CNCG the initial dare to moon the traffic from the window to begin with. Yes he took it a step further, and went out on the roof. Yes it was dangerous. Sure he should not have done that because he could have gotten hurt. But I’m just as much to blame on that one. But you seem to have left that out. Why? I thought you wanted to show how bad other people that attended were. Why leave me out? Now I feel all rejected and shit.

Ok, so let’s talk about your misdemeanor. In North Carolina, possession of a Controlled Substance, with paraphernalia (that would be the pipe MG) is a Class I Felon Charge. How do I know this? Because I worked in the law enforcement field for 4 years here in NC. As a matter-of-fact, here are the actual charges Z, you, CNCG, Tonie, and SG would have faced if the police had walked in on you guys:

Possession – Principal (you and CNCG)
Possession With Intent to Distribute - Principal (Z)
Possession – After the fact (Tonie and SG)

Out of the five, you and Z were the only two that participated (from your own confessional post). Only three of you were in the room when it was being done (again from your own confessional post). This is where the “more than one offender” comes into play. And this is also a place where the one’s involved put another’s well being at risk without their consent. Tonie & SG weren’t even in the room when it happened, but they would have both been charged; Tonie because the room was reserved in her name, SG because he was head of security. CNCG could have told you guys not to do it around him yes. But he shouldn't have had to. It was not your room, so you shouldn't have been doing it there. So I don’t care if it were one puff you took. You were in the wrong. You knowingly participated in an illegal act, plain and simple, admitted by you in your post, which coincidently has been screen captured instead of copied so there is little chance of it being altered. The “little dance” would have affected only one, and the AV incident was not a violation of any law. Now I ask you, were did the greater risk come into play? But regardless if it was a misdemeanor or a felony, is it right to put people who weren’t even involved at risk of obtaining a criminal record of any kind? I think not. And I have to ask this. When you say you thought it was ok for you to smoke marijuana because one person didn’t say anything, where did the reasoning go that it was an illegal act, and when did it become ok for anyone to commit an illegal act under any circumstance? The last I checked, it was still illegal in North Carolina at the time we were in Charlotte to possess or use an Illegal Narcotic. Not to mention it was morally wrong for you and Z to put other’s at risk of incarceration for you acts.

You know MG (yes you know because it was included in your post) I even went as far as to extended an offer for you to contact me directly with your questions or concerns, because it was I that the incident was reported to. And it was I that approached Z about the incident. Had I understood better at the time, I would have approached you as well that week-end, and discussed the matter the same way I did with Z. Yes I did approach you the next day when the Security Team was going around talking to everyone reinforcing the safety issues and encouraging people not to do anything that would be deemed as illegal. Had I understood that you were involved with the marijuana usage the previous night, I would have addressed that fact as well with you, and it would have been done discreetly, just like with Z, out of respect for your privacy, and not to mention out of respect for the other’s that attended. But maybe you don’t understand the act of respecting another person’s privacy. In fact, you have demonstrated that fact to me personally on four different occasions. They are as follows:

1st when I called CNCG out into the hall so I could try and calm him down and talk to him, you took it upon yourself to join us. He plainly told you he didn’t want to talk to you about the matter, yet you continued to pester him. Admittedly, you were telling him what could happened in the worse case scenario had it actually been a violation of copyright laws, but you were also blowing the situation out of proportion, and in turn getting him more upset.

2nd the very next night you came into the hospitality room and began bragging about an incident you and two other parties were involved in shortly before. An incident, to my understanding, that was a consensual act with certain stipulations. By you breaking those stipulations, you then turned the act into a “Breech of Consent”, and then turned around and told anyone who would listen to you about what you had just done. Again I am not calling the names of the other party’s involved out of respect for their privacy, you however did not show that same respect.

3rd when you decided to take partial information from conversations held in PM’s and post them openly on the threads for all to see. Why did you only stop with the partial information? You may as well have posted it all, or could it have been the fact that the other information would have gone more against you when you were trying so hard to point a finger to get out of the hot seat.

4th by actually calling the identities of all involved in the narcotic incident. Up until you did that, there were only a handful of people that knew who was actually involved. They were the ones involved in the incident, the security team, and the ones involved in planning the next party, and of course whomever the parties involved in the actual incident told. The planners of the next party chose not to disclose the identities out of respect for your and their privacy; however, you felt it necessary to point out everyone when you posted what was in the PM’s.

I do hope this is the end of discussion on this matter because I for one and tired of this little fiasco steadily being brought up. What’s done is done, and can’t be changed. You can now either accept the fact that you won’t be invited back to the party because of a majority decision, or you can’t. In all honesty, I could care less what you do for yourself. Your pleasure in life is not of my concern. My concerns are of the well being of my families, both my immediate, and those here on Lit I consider family, neither of which you are a part, and I will not sit by and let you drag good people through the mud just because you can’t be man enough to own up to your actions without trying to place blame on others.

I do have to agree with you on one aspect. This is more of a soap opera than my Ex wife as well. And it’s sad really, that people like you can’t accept the fact that they did wrong and now have to face whatever consequences. Would you have rather we turned you over to the police instead? Maybe that’s what we should have done in the first place. However we chose to handle it with a little more finesse trying to let each of you retain a little self-respect. And I also have to disagree with you on another point you made. Your statement, “It's a shame too, 'cause I thought I met a lot of nice, level-headed, spiritually nice/positive people at the Spring Litogether. Guess I was wrong.” No MG you weren’t wrong on that. Almost all of the people who attended the Litogether did in fact fall into that category. In fact, overall it was a huge success, and according to many that were there had an absolute blast. And that is the way we want to keep these things going. Not have to worry about who's going to do what next that may get us into trouble.

In closing, (why do I feel like an attorney after all this?) I do have to say this. MG, if in your research you run across a few references on common sense, my advice is to read up on it, and to utilize that “higher education” in ciphering a few morals from such.
