Disney Checkmates DeSantis

Disney's attempt to streamline its case against desantis denied without prejudice over a formality:

“Plaintiff’s motion to amend is DENIED without prejudice because it does not comply with Local Rule 7.1(C), which requires a certificate confirming compliance with Rule 7.1(B)’s attorney-conference requirement,” U.S. District Judge Allen Winsor wrote. “Plaintiff may refile the motion after conferring with Defendants and otherwise complying with the Local Rules.”

So the legal battle continues but it does seem as if lawyers for the state board have dragged the battle into their preferred forum. Getting to the obvious question, is this a win for Disney or a loss? Dan McLaughlin says its a loss:

2. The fact that Disney dropped all its claims against executive actions means that its sole remaining claim runs up against formidable 11th Circuit precedent, Ala. Educ. Ass'n v. Bentley (In re Hubbard), 803 F.3d 1298 (11th Cir 2015).

3. Under Hubbard, "when a statute is facially
constitutional, a plaintiff cannot bring a free-speech
challenge by claiming that the lawmakers
who passed it acted with a constitutionally
impermissible purpose."
— Dan McLaughlin (@baseballcrank) September 7, 2023

5. Put simply, Disney got outlawyered here by DeSantis's team. The people who told you it had a slam-dunk federal case have some egg on their faces right now.

Disney isn't the only ones with egg on their faces, there are a lot of lit Progressives and trolls with the same problem right now.

There’s a pretty large organization based in Florida that’s been getting people into crazy contracts since the middle of last century. And I’ve never heard anything about DeSantis challenging them. Very telling. If he didn’t see political gains in going after Disney, maybe he wouldn’t be doing it. One can hope future governments will be wiser. The organization I’m talking about knows how to play both sides of the political divide over woke issues and is stronger for it. DeSantis, not so much. More details about my statements will be given in private Conversation, I don’t want to derail this thread.

Maybe if Disney woulda hired Tranny Lawyers they coulda had success

Disney had no chance to win, the law is, and always has been, solidly against their claims. Their remaining claim will go away too because In Re Hubbard prohibits them succeeding by claiming that DeSantis was motivated by an improper purpose.

There are those on this very forum who loudly and laughingly point at my posts and say I'm a horrible lawyer who doesn't know the law. And yet here we are, right where I said we'd be.

I can imagine dentists chortling with glee at all the unexpected but very welcome dental work they're going to get from the teeth gnashing by the Left over this. Dentures might even go up in price due to sudden demand.

Dude ... the 'w' thing ... not a word.

DeSantis won. Not completely YET, but he won.

You and the rest of the Disney/woke cheerleaders lost. Take the L and learn from it.

Me!
Guilty!
I am one!
And it’s because you are horrible at life, politics, and yer so called lawyerly lawyering.

“DeSantis won. Not completely YET, but he won.”

This hasn’t even gone to trial and you make a claim like this. What kinda crap lawyer, outside of trump hired, would ever make a serious sentence like that?

Per CNN: While Disney’s claims of contract and due process violations regarding its special taxing district have been dropped from the federal lawsuit, those issues will still be heard in the separate state court lawsuit filed by DeSantis’ oversight board.

If I tell everyone here at 10:00am that’s it’s noon and continue to inform everyone that on the minute, every minute, for the next 120 minutes - I don’t stand up to be declared a prognosticating prophet when the clock says 12:00.

But, yet, here you are.

Hahaha!!! 🤣🤣🤣

"DeSantis' board has now revealed that, while they were snoozing, Disney executed an agreement with their predecessors that strips the new board of all its powers except the authority to "maintain the roads and maintain basic infrastructure,” according to one of the new board members.

Hilariously, the agreement Disney reached will remain in effect at least until 21 years "after the death of the last survivor of the descendants of King Charles III, King of England," currently living."

Yup, their entire narrative is imploding before their eyes.

First it was "checkmate" until Disney dropped some of it's claims. Then it was "take their money elsewhere" which has now returned a slap in the face by Disney announcing new investments in Florida.

At some point the dipshits like zippitydodo will have to concede that they backed the wrong side.

No surprise that you don’t like people having the freedom of speech.

Disney never said they were not investing in Florida. What they did was pull a bunch of investments they were going to move forward on this year. Those were pulled.

Now where in that SEC filing is the above investment?

"Walt Disney World is still performing well above pre-COVID levels, 21% higher in revenue and 29% higher in operating income compared to fiscal 2019," Disney CEO Bob Iger shared during the company's third-quarter earnings call.

Now of course it has two fold impact, clearly woke ain’t broke…but doesn’t help their case for damages from the Nazi Ron Community ASSociation.
