We have laws already for "under the influence." They're already enforced.

Just don't arrest the guy walking down the street high. Yes, arrest the surgeon and the bus driver, if they did something already covered by a law like murder or mayhem or criminal negligence.

Crimes happen, we can work toward preventing them.

In the meantime, let's punish what happened and not what potentially happened. In that way, we keep prison population down, don't put otherwise innocent people away, and we focus on the actual bad guys. We are overpopulated.

The crime rate in England and Wales is much lower than the US however you count it.

It is expensive to keep people in prison. In the UK our prisons are at or over capacity already. We couldn't afford a US rate of incarceration, nor would we need to.

And if you ask me, it isn't nearly high enough.

And it isn't just poor black men who belong. Throw everyone who breaks the law in prison. And teach them how to make it not happen again while they're in there - enough of turning prisons into crime colleges. Turn them into rehab and training facilities. So yes, the prison rate would be much higher this way.

Seeing as how more people would be disinclined to reoffend, the rate would drop dramatically after a while.

Yep, and enforcement is expensive.
Plus, prohibition eliminates any effective controls.

Liquor store owner will rarely sell booze to a minor.
Why?
Well the owner can likely lose his liquor licence, which means loss of livelyhood and possible jail time.

A drug deal has no compunction is this regard. To him, one person's cash spends just like another's, the sanctions he faces are rarely any worse and his suppliers will happily re-supply him as soon as he's available.

Besides, what criminal cartel has ever, EVER been able to successfully compete with a corporation out to make a legal profit?
